Non eea with british citizen ship

Post by Hauer72 » Sun Aug 08, 2021 8:48 pm

Dear sirs,
My husband is eea with settled status.
Myself non eea with settled status.
Both have valid resident cards.
My sons (6 years) resident card expired at the end of July 2021. He has got british citizenship.
My question is: would he been denied boarding on return to the uk?
We are going from non eea country transiting germany. I have contacted Stupid and they said they go with what uk gov requires. I could not find anything onthere for this circs.
Thank you

If your son is a British citizen why does he have/need a residence card?
Does son have a British passport? In that case there's no issue.
Is son also an EU national? In that case he's a non-visa national and should be accepted on the flight.
This is just my opinion as a member of this forum and does not constitute immigration advice.

Hi
Thank you for quick reply.
Yes he is british citizen. He got residence card back in 2016., and citizenship 2 years later.
Holds only non Eea passport.
Got NO eu/british passport.
We did not plan this journey, came as a surprise that is why I have not got british passport for him.
But I am affraid to leave uk as I think he wont be allowed to re-entry uk.
Thank you

I think your concern is justified.

Your son may argue his case at the UK border and he may be allowed to enter after a lot of hassle and delay but he can only get to the UK border if an airline allows him to board a flight which is unlikely as he only has an expired residence card, no visa (assuming he is a visa national) and no British passport, i.e. no clear evidence that he will be allowed in.
