Can dependent kid eligible to get ILR if parents get the ILR ?

Post by syamK » Sun Oct 17, 2021 12:26 pm

Dear Team,
I am on a skilled worker VISA and I have a kid born in UK and recently visited to India. I wanted to know how many days can he stay outside UK so that he will be eligible to get ILR after 5 years.

If I get ILR in UK will my kid automatically gets the ILR status irrespective of his staying time in UK ?

Thank you.

There is no absence limit for children.

Nothing is 'automatic'.

A UK born child does NOT need ILR. Once either parent is granted ILR, the child can be registered as British on form MN1. They have an entitlement to register as British if UK born.
