ILR- Qualifying Period spouse visa

Post by yelka » Mon Oct 02, 2023 10:37 pm

Hello everyone,

Thanks for all your help on this forum, it's been greatly appreciated.
From the link Zimba provided ( indefinite-leave-to-remain/advice-relat ... l#p2110176) am I right in thinking that I can try to submit my application tomorrow before the fee increase but enroll my biometrics in late October (see the timeline below)?

I am on spouse visa, first decision made on 20/11/2018, then I applied for a second 30 months period and will reach the qualifying (60 months minus 28 days) IRL (M) period on 23/10/2023?

Many thanks in advance,
Liza

Did you apply for your inital spouse visa abroad or in the uk?

Also, please do not tag your questions onto other members topic it is considered rude and unfair.

Hello, sorry, I didn't realise that was tagging someone else, apologies for that.

Yes, I applied for spouse visa in the UK, I was already there on student visa.
I am also confused as to when the qualifying period starts - from the moment of the decision (I've got a letter from the Home Office ''Grant of Leave to Remain - Five Year Partner Route) or would it be from the moment the first BRP has been issued?

Thank you

Thank you very much. Am I right in thinking that I can’t submit the application earlier and will have to do it after the fees increase? Or can I submit the application today but select the biometric day at the end of October (when I reach qualifying 60 months minus 28 days)? I keep reading different information and not sure whether I should be on a cautious side.

Submit before fee increase, book and attend biometrics appointment after the date you are eligible

I saw the link, thank you. However, I read it as the date of the application has to be 60 months minus 28 days, not the date of biometrics enrolment

I explained in detail that is NOT the case, the date of decision is the important. I did NOT say that the date of biometrics was important at all. Go read that again !
