eVisa Status is incorrect

Hi guys,

After being migrated to eVisa (ILR), the status shows as:

NAME: PERSON'S NAME
STATUS: DEPENDANT

Legal basis of status

You have been granted settlement in the UK (also known as indefinite leave to remain).

Question: Why does it show status: dependant if the person in question has ILR? They were originally on a dependant visa (T2 dependant) but then applied for ILR at the same time as the main applicant. My understanding is that their dependant status ceased to exist after they got their ILR as they are now on their own and do not depend on the ex-main applicant who is now a British citizen anyway?

Is this a mistake? Does anyone else also seeing this status in their eVisa? A bizarre and confusing thing! Thanks.

eVisas system may not show the latest status. This error has been reported a lot. Try to complain to the UKVI

Thanks a lot! Glad we are not the only ones. Do you know by a chance how to contact them to raise this issue / file a complaint? Shell we call them by selecting one of the categories in the account (like viewing your visa status) and then dial in to the phone number provided? Or are there alternative methods? Thanks.

An update: we called there and had the absolute worst attitude ever experienced - rude, unprofessional, unhelpful.

Basically, the person on the phone said that "Status" reflects the route the person took to obtain the ILR. As my wife was a T2 Dependant when she applied to ILR, the "Status" correctly shows "Dependant" which is utter rubbish as "route" and "status" are completely different things (route is the route one took to get there and status is their current status in the UK) .They said they are not going to fix anything as it is correct and if my wife wants it to show as Settled, she needs to apply to ILR on her own rights (I can't believe in absurdity of this statement!). As if this not enough, they were saying like "It shows as Dependant but underneath it says you can work here and there is no time limit, so it is correct" (no, its not!).

Question: what should our next steps would be apart from writing a complaint to home office and waiting god knows how long for them to ever review or get back? Shall we speak with a lawyer at this stage or do something else?

I think the most important thing is that your spouse can live and work in the UK indefinitely. Exit and enter without problems. But I know you don't feel this way.

Did you know that those that claimed asylum still have Refugee Settlement on their ILR?

Sometimes you just leave things as they are if they don't trouble you.
No sin in failing, you just have to try and try again!

Yes, I understand the point you are making and its fair. But I want to understand why does this status show as dependant - her ILR BRP does not say anything regarding dependant and its the exact same ILR BRP that I had back in the days. So why does the online status show as dependant then if her dependant status legally ceased to exist the moment she obtained the ILR? In your example, it clearly says the "Settlement" word (Refugee Settlement) but in her case it just says dependant with no mention of the word "settlement". Whilst she can freely live and enter the UK, the very status of dependant might create a lot of confusion here - you know how most people who have absolutely no idea about immigration laws will act,for example, if she applies for a study course, she can potentially face bureaucratic barriers in explaining the ordinary uni workers that she is basically settled and not a subject of higher fees but need to pay home fees. This is just an example out of many other potential scenarios. Why not to dig to find the bottom of this instead of relying on confusing and misleading information that the agent on the phone provided, considering that these agents are not even home office employees, but third parties who know little or nothing about immigration statuses and laws, and just blindly input things into the system.

There are too many of them. You're absolutely right. A friend of mine had to explain to a recruiter what the spouse visa was. It was during Brexit, and the recruiter kept hammering on the fact that the company he was recruiting for needed longevity and my friend might leave with the spouse after Brexit.
He said his spouse is British and that's what those with spouse visa mostly are (British or settled)!

I'm inclined to believe that these are teething problems. Give it till February or March and give it another go. If you have the patience to wait that long.

There's truly is a massive difference between settled and dependent. Most of the data entry persons just do the usual garbage in garbage out with the data they're provided.

Yes, exactly. This is why I am very angry on this nonsense. She sent a complaint to UKVI, let's see what they will say. Maybe someone else in this forum already dealt with a similar issue and would provide more insights on how to battle this.

This is getting ridiculous. Received the following email after complaint and it doesn't even cover my complaint, but just a generic email. Shall we contact a lawyer at this stage for them to send an enquiry on her behalf? Or shall we wait for her naturalisation 6 months period to come and then raise this? Will appreciate some thoughts. Thanks.

No need to get a lawyer involved in this case.

This issue is quite common as commented above. I had a similar situation with a previous immigration status - before this eVisa system was announced but the problems reported now are related. The digital platform remained showing me the wrong status for some time before it got resolved by itself. I didn't send any complaint. I guess it's a system glitch or something, but it doesn't have any impact on the person's actual immigration status.

I appreciate that it's still concerning and not an ideal scenario but this has happened to many and these issues are usually resolved by UKVI automatically.

That is either not an issue to work, study, etc. Employers or academic institutions can use some tools (e.g. the ECS service) to manually verify the immigration status of an individual, independently of what the digital platform shows to the individual.
