Question about visitor’s visa refused

Hello,

I recently applied my family visit visa to uk fir 4weeks to attend my nephew’s wedding with all
supporting documents including my propery,wedding card, cousin sporship for rent free accomodation, my employement documents, my family ties in india but they refusec my visa with vague reasons so i had applied pre action protocol judicial review and sshd reconsider case based on my factual presentation that means they will grant me visa?

What were the exact reasons for refusal??

What ties to your home country exactly did you submit?

We have submitted my real brothers family id card like adhar card.

have refused your application for a visit visa because I am not satisfied that you meet the requirements of paragraphs V4.2 – V4.6 of Appendix V: Visitor because;
• You have applied for a visa to visit the UK for 1 month for family visit. To assess your application and intentions, I have to take into consideration your own personal, social and financial circumstances in your home country.
• You have stated that you are employed and have a monthly income of 85670.00 INR (£768.542 were £1 = 111.471 INR Oanda.com at time of assessment). You have also declared savings of £19,000.
• In support of your application, you have provided a marriage certificate, birth certificate, employment documents, documents demonstrating your sponsor's circumstances in the UK, bank statement in your name and other supporting documents.
• Please note that this assessment of your provided documents regarding your employment, economic ties and personal circumstances is not related to whether you have sufficient funds to cover the costs of your visit. Rather, it is to examine whether I am satisfied that your self-declared personal circumstances have been demonstrated by the provided information.
• I acknowledge your bank statement shows credits in keeping with your stated income. However, I am not satisfied that you have demonstrated you have sufficient ties to your home country.
• It is further noted that on your Visa application form you have stated that you own your current property and that you have done so for 10 years. However, based upon the information provided it is unclear whether you own your home as claimed.
• You have stated that your spouse and child is travelling to the UK with you. By contrast, in making my consideration of your familial ties to the UK, I note the presence of your sister, brother-in-law, 2 nephews, mother, cousin brother and uncle who all reside in the UK. This, in conjunction with the concerns relating to your economic ties and property ownership as stated above, gives me reason to further doubt that you will depart the UK at the end of the period stated by you.
• The discrepancies and concerns outlined above has led me to doubt the overall credibility of your application. On the balance of probabilities, I am therefore not satisfied that you are genuinely seeking entry as a visitor or that you intend to leave the UK after a limited period. Your application is therefore refused under paragraph V 4.2 (a) and (c) of the Immigration Rules.

No it doesn't mean that. It means that they'll look at it again. Visiting for 1 month is never a good sign. Also declaring that much family ties to the UK is almost like shooting yourself in the kneecap.

Thanks for your quick reply I would much grateful if you help me regarding when they will send their decision as wedding date is approaching soon. I have already send email to expedite the process and also called on their landline no they have assured me that wait till this week but its mid week but no reply comes till the date.

Furthermore I would like to clarify that I have submitted all relevant documents based on my employment, my daughter's school documents, my property documents including property valuation report with tax bill and electricity bill to demonstrate that I have very much established life in India including my brother's families adhar card which proves that I have very much strong family tie up back in India but still they have refuse my application on the basis of assumption and dout that I will not return at the end of my trip because of my mother and sister nephew cousin lived in London.

In my PAP judicial review I have clarify everything with same documentary evidence attached which was ignored during my original application and SSHD has reviewed my application carefully and he finds merit in my application then he has given me resolution to reconsider my application. My assumption is that if SSHD has directed to UKVI to reconsider my case means he has to follow the higher authority the only reason if I have strong compelling situation then only they will refuse my application. please help me with this situation I am very confused till the date there is no reply came.

It's not clear how the PAP will change the decision.

You have several immediate family members living in the UK and didn't provide enough evidence to convince them that your intention is not to stay, that's the reason why UKVI considered that your ties to the UK are stronger than the ones to India.

When submitting evidence on properties, UKVI want to see property deeds or ownership documents on your name. Tax or utility bills themselves are not proof that you own a property. A property valuation report (as it stands) is not a proof either.

You cannot speed up a PAP process (or visit visa application). Unsure what you mean with compelling situation, a wedding can be an important family event but it's not considered as compelling for immigration purposes.

Could someone please help on below: URGENTLY

1. My sister's visit visa was refused previously before marriage and below are the refusal reason, now she wants to apply visit visa with her husband , so I just need to check if She needs to mention about refusal in new application? If so then how would she cover it with explanation?

2. ⁠She is applying on her brother's sponsor ( British national), what documents she needs from him?
3. ⁠what documents she need to attach from their side (wife and husband)?
