Bit of background first , I am from Indian state of Kerala . Lot of people from my state works in gulf countries like UAE , KSA etc.It is common in my state for potential employees to pay middlemen / agency huge money for work visa to the gulf . This is sort of corruption & grave human right abuse were middle men charge exorbitant money for the free work visa. As the state has very high unemployment lot of people are willing to pay hefty amounts on the tune of 10k -20k GBP for an opportunity to work abroad.
Sad to see that , same started to happen in care ( there are some reports in guardian about this ) and restaurant sector in the UK as well. I personally know a chef who has come to the UK 6 months ago after paying 20k GBP to the restaurant owner who provided him the work visa. He worked here for 6 months . He was not paid proper salary . Somehow , he escaped from the controlling restaurant owner & has managed to get a new visa with another restaurant .
I talked to the victim . He is saying that he got some legal advice that he shouldn't declare to UK authorities that he paid money to get the visa . He is saying that it would be counted against him. I can't understand this . He was cheated , why can't he tell the truth . Can someone explain what's happening here legally ? So far , he hasn't pressed any charges against his previous restaurant owner.It seems he has no idea about UK legal system .
