Carer VIsa renewal

Post by Yemiasa » Fri Dec 27, 2024 8:55 am

I am a uk Homecare worker and my 3- year visa will be due for renewal by march 2025.My employer has indicated interest to renew my visa but I am concerned about not meeting the annual financial requirement for HO visa renewal .Annual financial requirement set for my profession should be 23,200 but as of today my total salary is just around 15k and i doubt if i can make up to the 23200 by the end of the tax year and this fault is due to my employer not having enough client to cover up for the hours .
Hence , I dont know if there is another yard stick be used by HO for this kind of situation like mine although my wage per hour is beyond the minimum wage threshold of 11.9/hr .
i need more clarification about this .thanks

Technically, if your employer doesn't have enough business to pay you the minimum requirement salary then your vacancy does not meet the conditions for sponsorship. There is no way around it.
Your sponsor license may be revoked or downgraded if it's found that he pays you below the amount stated in the CoS because he doesn't have enough business to support your employment.

As your employer has not honoured the salary stated on your previous COS they are in breach of their sponsor duties. When the Home Office notices the salary you have been paid they will start to question the reason for continued sponsorship and if the role is a genuine vacancy.
I am assuming you are in domiciliary care and have ad hoc working hours and that you are only paid for hours worked?

Your scenario is very common and more and more sponsors are losing their licence because of this abuse. My advice is to look for another sponsor that can and will pay you a living wage.

Are you quoting your net salary or your gross salary?

If you're 21 or over, and working 35 hours a week you should get a £20,820+ a year gross salary at the national living wage (the minimum wage), never mind the salary requirements for your visa.

If your pay is lower than that, are you working fewer hours?
