Stamp4 EUFAM Visa

Post by blastbass106 » Tue Mar 11, 2025 3:45 pm

Hey Guys let me tell you a story.

My wife (Bosnian citizen) did receive her Stamp 4 EUFAM Visa in 2020 and when we tried to renew it online in December it has been initally approved, for the card never to arrive. Beginning of February I did submit a query via the DOJ Portal only to be informed today that the approval was a technical error and it hasn't been approved actually due to an issue with the DOJ Letter from 2020 when we got the 5 year IRP for EUFAM. Then I have I have been forwarded EUTR 1 and EUTR 3 Forms to fill out but I don't understand whats going on here.

Worst of all her IRP expired mid February and while I am aware of an 8 weeks Grace Period what should we do?

I'm scared and so is she as we are in the process of buying a house and I have no idea what to do.

Can someone shed some light.

Regards

Hi,

You can't use the same permission letter for 2020 to renew her permission.

Since she has been in the state for more than 4 years and half, she has to apply for permanent resident card with EUTR 3 form and requirements. If you don't have the requirements for EUTR 3 for 10 years residence card she can apply again for EUTR 1 for another 5 years. That's the reason why they sent 2 forms.

*She was supposed to apply for EUTR 3 permission letter 6 months before the expiry of her 5 years card.

**I suggest she applies for another EUTR 1 5 years permission (This will be issued regardless of the expiry of her IRP) then when granted she can use it to apply for Irish citizenship straightforward after 1 year.

Thank you very much for the response.

Isn't it a requirement from EU TR1 to be outside the country?

Also another thing that I'm dreading to ask. How does this affect a mortgage application. We want to buy a house, have an AIP and all the funds required.

She works here since 2021 with a stable income and is also fearing that she has to resign or being let go due to the expired IRP.

And are there any online info specific to this case to learn the general implications of an expired visa.

She has to apply for EUTR in the state. She can just submit another EUTR1 application like her previous EUTR1 application. I am sure her application will be processed faster.

Regarding the loan, you have to wait until she receives her full Stamp 4EUFam. Not the temporary stamp 4.

If her employer hasn't requested for a new IRP, it's best she keeps quiet until her application is finalised. So far as you the EU citizen is working she is allowed to remain.

Isn't there anything one can do to challenge the technical error as in reality that cost us 3 months we would have had time to get the process going. Checking the processing times that would have just been fine. That's time we don't have anymore and essentially her work is at risk, our mortgage is at risk and God knows what else

There is nothing you can do. On her previous permission letter it's started she has to apply for permanent residence 6 months before her stamp 4EUFam expires to avoid any gaps in her residency. It's obvious EUTR1 and EUTR3 are not the same so would have different requirements.

If she applies for EUTR3 now they might delay her since her permission has expired but she can apply for another 5 years again then after 1 year apply for the EUTR 3 or straight citizenship.

Hello everyone,
Hope you’re doing well.
I had a query about EUFAM visa, I came to Ireland on October 2024 and applied for IRP registration first time on October 27th 2024. My wife is an EU citizen and me being Non EU citizen had to apply for IRP card, after 2 weeks from applying got a letter from EU treaty asking for a document which I already provided, even though I sent it again on November 17th 2024. I haven’t received any confirmation or acknowledgment since then, I had sent out 2 emails in January 2025 and got a reply “your application is in processing queue will processed in a chronological order” now it’s been 2 months since that email, still haven’t heard anything from them should I be worried ? Because one of friend who came on same EUTR visa and applied in the month of February 2025 for an IRP has received an appointment letter for temporary permission yesterday.

Hi @Tabishdoni

The letter you received requesting for additional document should be the acknowledgment letter.

Check on the top right corner of the letter for Person Id and Application number.

You can send a query via customer portal requesting for a temporary stamp, reason- You will be travelling with your spouse to visit her family abroad.
