9 year old with ILR

My 9-year-old obtained ILR when he turned 7. He was born in the UK and has never traveled out of the UK. Both his parents have Leave to Remain. Can we apply for his naturalisation despite us, his parents, not having ILR?

If non of the parents hold ILR you will need to wait until the child is 10.years old.
Once the child is 10.and given he meets the character requirements use form T to register him.

If you use section 4 you may apply for fee wavier so depending on your circumstances you can consider this as well.

If one parent is getting settled in the mean time you can immediately use form MN1 to register under section 1(3).

Thank you for the reply. I have always believed that anyone can apply for British citizenship 1 year after being granted ILR.

I paid £1630 for the application but realized it should have cost £1,214. That's when I decided to check further.

Do you know if I can get my fee refunded? I have booked a standard appointment to submit documents so I need to cancel the appointment. He will be 10 years old in January next year so not sure I can defer till then.

Under any circumstances don't go to.the appointment. The application should be withdrawn after a while.

If you paid the incorrect fee you used form AN1 this form is for adults! In January use form T, this is special form for application under the 10 years route for UK born children.

I applied online. I believe the form is MN1. I have uploaded relevant documents on the TLSContact website but have not submitted them. I have an appointment booked for 21 March.

I read here - https://www.gov.uk/government/publicati ... april-2018 - "Fee for handling and processing an application
You will not get a refund if your application is refused or withdrawn.

If your application is rejected the overall fee will be refunded less an administration fee of £25 per applicant. This document has no legal authority as an interpretation of the British Nationality Act 1981 or the current Fees Regulations. It is intended as a guide."

How can I get a refund, please? Is it possible to cancel the UKVI application after payment and get a refund? Should I cancel his appointment with TLScontact or just not attend?

I need my hard-earned money please from UKVI.

If you don't attend the biometrics appointment your application will be considered void, not rejected. You will get the money back eventually but it may take weeks or even months. If you paid £1630 you must have applied with form AN.

Hi,

I have 2 questions, please.

I have another child who will be 7 years old in a few months.

1. Would he be able to apply for citizenship without holding ILR when he turns 10 years old, his parents haven't got ILR or British citizenship yet?

I am wondering about the benefit of ILR for him since he won't qualify for citizenship until he is 10 years old.

2. Can you advise me please if there is any benefit of ILR for a child whose parents haven't got ILR or British citizenship yet?

Where is this child born? If born outside the UK child must have ILR before being eligible for registration.

when one of the parents gets ILR or gets British citizenship this child will be able to apply for registration. No need to wait until child turns 10 if one of the above happens before. This child won't need ILR I believe but if the visa expires you need to secure private health insurance until you receive the outcome of the registration.

I have received email from the HO below. Should I respond or call them. If I don't, would they make a decision and return my application fee? Thank you.

"Dear [Applicant name],

Following your recent application for citizenship, you should have enrolled
your biometrics (scanned fingerprints and photograph) in line with the process
set out when you completed your offline application.
You were previously issued initial instructions on how to book an appointment
and enrol your biometrics within 45 working days.
This notice is to remind you that biometric enrolment is required within
45 working days of your application date. Please note if you have
booked an appointment after this date, email with confirmation receipt
from our service provider to this email.
You must now return to your online application to book and attend an
appointment at a UK Visas and Citizenship Application Service point to
provide your evidence and enrol your biometrics (fingerprints, facial
photograph, signature).
When you book your appointment, you will be advised what you need to bring
with you.
If you do not attend an appointment and enrol your biometric
information your application will be rejected as invalid. This will apply
even if you have provided all the other relevant information, evidence
and payment required to validate your application.
If you are under the age of 16 you must be accompanied by the
responsible adult that you named as part of your application. If you are
not accompanied by this person your enrolment cannot be processed.

You and your parent/responsible adult must provide an acceptable form
of identity; this must be a passport, photo driving licence, national identity
card or a UK Biometric Residence Permit. The proof of identity will be
checked against the details given on the application form.

Ah - I misunderstood the email to be about the MN1 application. Yes, do not attend the biometrics appointment for your initial visa application - but you will need to attend one when you apply for MN1. Ignore the email unless it refers to MN1.

Hi, I made the application for my 9-year-old using MN1. We, his parents, have got LTR. I understood we need to wait until he is 10 years old to be eligible to apply independently. Hence, we have decided to wait until January 2026, when he will turn 10.

I also understood that the form to use would be T1 for the application.
