Italian Citizenship by descent

Post by gavw95 » Sat Feb 22, 2025 1:26 pm

Hi,

I have recently been doing some research on my family tree and ancestors. My great great grandparents were from Italy and my great great grandmother moved to Scotland in the early 1900s. However, from speaking to family, my great great grandfather never permanently moved here, and instead came and went from Scotland to Italy and he and his wife had several children during this time (including my great grandfather, who went on to have a child - my grandmother). I believe, through Ancestry that my great great grandfather was born and died in Italy, whilst my great great grandmother, was born in Italy and died in Scotland.

I am now looking into Italian Citizenship by descent and I'm looking for some help or advice from anyone who has been through this process, or knows a bit more about how it all works when it comes to collecting the relevant documentation.

So far, I believe I have managed to locate my great great grandfathers birth certificate through the Archivio di Stato di Caserta online - https://antenati.cultura.gov.it/ark:/12 ... 66/w9lZojp - however, I'm struggling to find his marriage or death certificate. I have emailed the Stato di Caserta to ask if they'd be able to provide a copy of his birth certificate and whether they have copies of his marriage and death certificates.

In Scotland, I have managed to locate my great great grandmother's, great grandfather's birth and death certificates, my grandmothers birth and death certificates and I have my fathers and my own birth certificates.

I have read the information on the Italian Consulate page, and believe I'd also need a declaration from the National Archives that my great great grandfather never naturalised here - which I hope shouldn't be too much of an issue.

I'm also not sure if I have emailed the right place to request copies of certificates in Italy. My family believe my great great grandfather was from Villa Latina - but I'm struggling to find more information on this - so have emailed the Stato di Caserta as that's where I can find a copy of his birth certificate.

Any help or advice would be appreciated!

Thanks,

Gavin

Firstly, you've probably missed your chance, as the right wing populist Italian government is changing the rules https://archive.ph/G2w9e

If that doesn't happen or is overruled as unconstitutional by courts, then:

If anyone in your line of descent was born to a mother before 1948, you'd have to apply through the courts as the consulates refuse to acknowledge your right to Italian citizenship by maternal descent before 1948. https://www.italiandualcitizenship.net/ ... 948-cases/

I believe birth certificates in Italy are typically held by the local Commune (roughly analogous with a local council in the UK), so your best bet for a birth certificate might be to contact the commune where you think he was born and see what they have.
