Dependent Visa Extension for a Spouse in UK

Post by KhanAdil » Tue Nov 04, 2025 11:23 pm

Dear all,
Hope you are well.
I want to put a scenario infront of you and will like to take your advices or suggestions:

I applied (10th of Sep 2025) for my wife’s dependent visa extension for three years based on my previous global talent visa. I myself currently hold ILR and have also got my citizenship application approved (last day of oath taking ceremony is 30th of Nov 2025), however I haven’t taken the oath yet and tomorrow is the day (5th of Nov 2025) for which I booked my oath taking ceremony.
My wife’s visa outcome is not with us yet and infact we were told last week (week7 since her visa application) to pay the due IHS amount, which apparently wasn’t paid at time of application (I paid for 2.5 years and they asked me to pay another .5 year as 3 yrs is the minimum extension given on global talent or skilled worker dependent visa ). I paid it immediately and it’s been a week now. The initial decision on my wife’s visa was supposed to be made by 5th of Nov (8 weeks time). However, I’m not sure if she will receive her decision/Visa by tomorrow (5th of Nov) or not.
My fear is if I go ahead with my initial appointment of oath taking ceremony taking place tomorrow (5th of Nov), I will become a British citizen and this will result in change of my status and therefore, it might impact my Mrs dependent visa application as they might ask me to re-apply for her as a spouse or family visa and it will reset the clock.
Can anyone please advise if I don’t attend the ceremony tomorrow and postpone my ceremony by end of Nov (even though if it’s private and have to pay some), will it be worth it waiting for my wife’s visa application decision first (hopefully will get it soon now as have paid the due payment of Ihs and shouldn’t be a problem to delay it). OR do you think it won’t impact her visa route as they have already asked me to pay for ihs top up for 3 yrs visa extension based on my previous global talent visa, which’s expired long time ago. If there was an issue they would have told me to switch to family visa as my oath taking ceremony was booked and I’m sure the citizenship registration number would be issued too to hand me over the certificate tomorrow (in case I attend it) but I know I can’t be British citizen until I take oath, so at the moment my status is still the same (ILR).

Please advise what do you think is the best solution.

Your help would be highly appreciated!
Many thanks
Kind regards
Adil

You becoming British doesn't change or impact anything for their visa extension!!!

Thanks very much for your prompt response!
Just for your information, one of my colleague had a skilled worker visa and he was long due ILR but he still had 1 yr left for his visa to expire. His Mrs was his dependent and he applied for her extension based on his visa expiry (i.e: 1 year, this also aligned with her 5 years dependent visa to ILR route). Anyhow During her dependent visa extension application process (4 weeks since application), he applied for his priority service ILR, which he got it next day. In week 5 (since her visa application), he received an email from home office that since your status has changed to ILR, you need to pay another 2 yrs iHS fee (as minimum extension based is 3yrs, once you are on ILR). He had to pay the additional iHS charges and now it’s week 7 (since her visa application) and she hasn’t received her visa yet. This was the reason it made me think if I’m also in the similar boat or is my case different.
Please advise.

Thank you
Kind regards
Adil

Thanks for your response.
If you don’t mind can you please elaborate it, how his situation is different than mine.
His status changes from tier2 to IlR, mine will change from IlR to British citizen.
His dependent visa extension route changes from 1 yr to 3 yrs. Mine could change from 3 yrs dependent visa to 5 yrs spouse or family visa.
Please if you can throw some highlight, It would be really helpful and appreciated.

Kind regards
Adil

You becoming a british citizen changes nothing. Your depends continue on their visa route until they qualify for ilr. This is clearly stated in the immigration rules.

Your friends situation was different because he applied for ILR while dependent visa extension was pending and because he did that, it has to be a 3 year extension, still on the same visa route, as stated in the immigration rules!!!

You already have ILR so their extension will progrss as normal. You becoming British has no effect on that!!!

You are overthinking here.
