Spouse Dependent away for 6 months before Visa renewal

Hi everyone

Greetings for the upcoming holidays 8)

My wife is on a Spouse/Partner Visa that began in September 2023 and expires in June 2025. I hold ILR.

Since our daughter was born in India, she inherited her mother’s visa status and had to apply as a dependent under the same Spouse Visa category, with the same start and end dates (September 2023 – June 2025).

My wife and daughter entered the UK in November 2023, and we all recently travelled to India in October 2025.

Our daughter was born in March 2023 and arrived in the UK in November 2023. For the past two years, living only with her parents in a flat in the UK has affected her social interaction and bonding.

During our recent visit to India, we observed a noticeable improvement in her social bonding and speech while interacting with the wider family. My wife has a large family—with her grandmother, aunts, and others—and the warmer tropical climate, big house with garden and family environment back home help her engage more with people rather than screens.

We are planning to return to the UK in two weeks. However, we feel it may be beneficial for our daughter to stay with the wider family until next year and return to the UK in March 2026, ahead of her visa renewal in June 2026.

Since my daughter (as a Spouse Visa dependent) would be outside the UK for approximately 6 months within her 2 year 9 month visa period, we are concerned whether this could cause any issues with her visa renewal or her future ILR application in 2028.

Please share your thoughts, as we are in a dilemma about the best course of action.

Your daughter is free to return closer to her ILR application time.
No sin in failing, you just have to try and try again!
