Child aged 17 dependent on Curtailed Skilled Worker Visa

Hi,

I need help because I got in to a difficult situation which I realised today.

Background -
I am on Skilled Worker Visa in UK from last 3 years and lost my fixed term contract in September 2025. My child aged 17 is on dependent visa studying at college from 1 year post GCSE here. I missed curtailment letter where 60 days expired 5 days back now.

I got a new employer in October 2025 who gave me offer letter and filed a COS for me. COS still not approved and organisation hiring me have responded all queries/documents/proofs to government on 11 Nov 2025 instead they initiated curtailment on 18 Nov 2025.

Queries -
1. What can be done now to save my child education, me and ILR which was due in next two years.
2. I have cleared few more interviews meanwhile (offer awaited) but HR always asks if you have been given any curtailment letter. Will it create some issue for me/employer if they file Skilled Worker Visa for me soon.
3. I am single parent and completely lost and in panic on what to do now. I am traveling to this country since 2007 and have never been in such situation ever.

Kindly help me.

What do you mean with CoS still not approved?

Did you apply for a new Skilled Worker visa already?

Undefined COS was filed by employer so that they can apply Visa for me, however Gov.uk came out with an email and 11 questions to employer asking evidences of taxes, turnover, what position toh are hiring for, how many candidates you have hired in past, how many will you hire in future etc etc. Share details of person whom you will assign this COS and employer responded with all evidences but cos not yet approved by gov.

That means you have not yet submitted an application for a new Skilled Worker visa. It also means you started to overstay your visa since 18 January 2026.

Unsure how you missed the curtailment letter, you also might have received an email with the curtailment notification.

You might be able to submit an in country application within the 14 days of the curtailment date, provided the caseworker exercise discretion on the decision. However I'm not sure how missing the curtailment letter is a good reason beyond your control.

Thanks much, I'll go through it. Will it require solicitor to file this application as I don't have any knowledge in this area.

Yeah, you are right. My got cancer third time at home and this time it's lung cancer. So, I am haywire in stuffs and missed it.

You don't need a solicitor to fill and submit a Skilled Worker visa application. However it's up to you to consult one as now your situation is a bit more complex after you became an overstayer. Whatever decision you take, you need to act now.

I am really stressed and want to clear that I never recieved curtailment letter via physical post. I have all the evidences (Digital as well as Physical). I missed email curtailment because of below:
1. E-Mail wasn't in Primary folder of Gmail.
2. I wasn't checking unnecessary emails/other tabs as my mother got lung cancer and I am on calls with family most of the time. I have all PAT scans, reports during this time.
3. I am a single parent and have parenting responsibilities at home apart from work.

Can someone help me?
