Husband on spouse visa... benefits?

Hi all,

So my husband is due for ILR November 2026. He came to the UK on spouse visa on November 2021.

Since then our 3 year old has been awarded DLA since February. (Middle rate care)
I have been looking to apply for UC (carer element) to help as well. My husband has left his job on 28 Feb 2026 and is currently not working (is looking gor jobs).
He had been in continuous employment since December 2021.(Changed employers three times)
No period of absence from UK or from job.

I work full time (37.5hr) and earn about 1755 after tax. When I apply for UC (carer element) obviously I have to declare husband had no NRPF.
Is this going to be issue for his upcoming ILR?

If you are claiming benefits you are entitled to, that will not affect your spouse’s immigration application. He will need to claim UC and link with your claim, but, he will fail the habitual residence test and your claim will be as a single person. Your husband could claim New Style JSA (it is deducted £ for £ from UC). You can use your UC towards the financial requirement for SET(M) as you are only required to show adequate maintenance and accommodation because you receive DLA for you child.
