Visa expired, MN1 is pending, child born in the UK

Hi, not sure if this is the right board, but thought I would post here.

My son was born in the UK in 2024 when both his parents were on skilled worker visa. Since then his mother (my wife) has got ILR, which makes my son eligible for British citizenship. We made his citizenship application in January, but the application is still pending.

Meanwhile, his dependant visa has expired on 19th April. His eVisa status reflects this. I understand he is technically now an overstayer.
My questions:

1. So, while we are waiting on the citizenship application, do we need to make an application to extend his visa (or apply for ILR), or carry on without a visa? Will carrying on without a visa have any implications other than NHS services? Is there a risk of deportation?

2.Though the visa is expired, I understand is it possible to make an application with 14 days of visa expiry to make the overstayer status go away, is this correct?

Your child is technically an overstayer, but as he was born in the UK, not an issue. Sort out private medical insurance and of course your child can't travel until the application is approved and you sort out a passport.

Thanks a lot. That is very reassuring. We are getting the private medical insurance.

I am very happy to confirm that the application for British citizenship has been approved (received Atlas Email today). I can't thank this forum enough for the immense support.
