Queries Regarding ILR Eligibility Dates for My Spouse

Post by bharatsingh » Wed May 20, 2026 3:33 pm

My Spouse’s Immigration History
My spouse joined me in the UK approximately 6–7 months later from India.
Her Skilled Worker dependent visa was issued on 07 March 2022 and was valid until 06 September 2024.
She travelled to and entered the UK on 02 May 2022.
Her current Skilled Worker dependent visa is valid until 19 September 2026.

Query 1 – My Spouse’s ILR Qualifying Start Date
Could you please confirm which date would be considered for calculating her ILR qualifying period?
Visa issue date: 07 March 2022
UK entry/travel date: 02 May 2022

Query 2 – Extension and Future ILR Eligibility for My Spouse
Based on the current visa expiry date, my spouse will only complete approximately 4 years and 6 months on the Skilled Worker dependent route, which leaves her around 6 months short for ILR eligibility.
I would therefore like to understand:
I)Once I obtain ILR, can my spouse apply for a short extension (around 6 months) as my dependent?
II)for full fill the 6 month of visa shortage, what category of visa do need need, skilled worker dependent visa or settle ILR visa or something else?
III)Does her existing time spent as a Skilled Worker dependent continue to count towards the 5-year ILR requirement?

Qualifying period starts from visa issue date.

There is no 6 month extension option.

She has to apply for a 3 year skilled worker dependent visa extension. You cannot choose a lesser validity.

Children born in the UK have an entitlement to British citizenship, when a parent settles. They do not even need a visa or ILR

I believe, they need MN1 approval before the visa expire. someone told us that, if you cant get approavl before than have to visa approval so in that case have to extend their visa againa for 3 year?

Not correct information from "someone" - as said above "They do not even need a visa or ILR" - this is information that is given many times a week. Recommend you follow the "British Citizenship" forum --> viewforum.php?f=42
This is just my opinion as a member of this forum and does not constitute immigration advice.

Not having a valid visa does NOT affect entitlement under nationality law for eligible children. Stop listening to random people who do not know what they are talking about
