Dependent Child Visa - Awaiting ILR decision on Main application

Post by jaaslam » Tue Jun 30, 2026 4:38 pm

We are a family of four. Our younger daughter was born in the UK. We arrived in the UK in June 2021, and that is when we became eligible to apply for Indefinite Leave to Remain (ILR).

I applied for ILR for three family members — myself, my wife, and my younger daughter — under that eligibility. My younger daughter's naturalization application will be submitted once I'm granted ILR.

My Younger daughter's current visa is set to expire on 14 July, in line with my own current visa expiry date.
I submitted my ILR application last week on a priority basis and was expecting a decision today, but I received an email from UK immigration indicating that the decision will now be delayed for various reasons.

So the situation is this: myself, my wife, and my younger daughter are protected and can remain in the UK because our applications are still in process. However, my younger daughter's visa expires on 14 July, and there's a concern about whether she'll be able to remain in the UK after that date while my ILR decision is still pending.

Such a child does not need a visa or ILR and their visa status is irrelevant while applying for an application under nationality law. This is because the child's entitlement under nationality law remains unchanged and their immigration status is totally irrelevant.

UK born children will not have any issues, even if they overstay. A minor issue could be losing access to the NHS for a short period of time (after visa expiry) until the child is registered as British.
