I am preparing the cohabitation documents for my family ILR application, but I noticed my name is written differently on several bills and letters.
Here is how my name appears:
Passport (Official Name): Amit Kumar Sethi. (here Given Name is Amit Kumar and Surname is Sethi)
Council Tax: A S
Bank Statements: A K S
Rent Agreement, Utilities and others : Amit Sethi

Could you please advise me me and advise on the steps how I can best proceed with this.

This is a non issue. Provide everything you have.

There is no specific cohabitation requirement under the immigration rules at all.

* National Identity Card Query: "For an Indian citizen completing this application, is it correct to answer 'No' to the question asking if I hold a National Identity Card?"

* UK Entry Date Query: "Regarding the 'date you first entered the UK', should I enter the date as on BRP for my Skilled Worker visa, or the earlier date when I first entered the UK on an Intra-Company Transfer (ICT) visa?"

* Absence Documentation Query: "To prove my absences, I am providing a signed self-declaration of my travel dates and an official letter from my employer confirming all leaves were approved, dates are not listed in employer letter. Please highlight if any additional evidence or details are required."

* Name Variation Query: "Regarding cohabitation proof, my partner(dependent) name appears as ‘Amit Kumar Gupta' on his passport, but supporting documents show variations like 'Amit Gupta', 'A K Gupta', and 'A Gupta'. Are these variations acceptable, and what specific guidance should I follow to address this?"

* Cohabitation Evidence & Consent Forms Query: "I intend to provide a joint utility bill showing both of our names as part of our cohabitation proof. Given this joint document, is it my correct understanding that I should sign Part 1 of the Home Office consent form and my spouse should sign Part 2?"

UKVI does not need or care about your national identity card at all

The date you put on the form is not important.

You do NOT need proof of absence, do not invent your own immigration rules.

I do not have to repeat the advice given to you. There is NOTHING you need to do with the name thing. The UKVI does NOT nitpick about that. As I explained very very clearly, there is NO SPECIFIC EVIDENCE that you need to send. The rules do NOT even mention cohabitation documents at all.

Remember, the things you are concerned with are NOT necessarily what the rules are concerned with.

When I am filling Set O, it asked me to provide cohabitation documents saying "If you have added a spouse or civil partner to this application form who is applying at the same time as you, please provide documentary evidence of cohabitation since you were last granted leave (up to a maximum of two years). Evidence provided should cover the whole period and be in the form of official letters or documents, addressed to yourself and your spouse.

I am thinking to provide as evidence of cohabitation for last 2 years. I am considering providing the following :
* Joint-name council tax bills (one document per year)
* Rental agreements (one document per year)
* Bank statements covering the three-month gaps between the other documents
Please let me know if I am proceeding in the right direction or if I should provide any additional documents.

Another query to add, please:

Regarding absences, what proof can I provide? While completing the application, I am being asked to provide:

“Letter(s) from employer(s) detailing reasons for work-related absences including periods of paid annual leave from the UK and Crown Dependencies for Mrs Bhawna Arya.”

I have received a letter from my organisation confirming that all my leave has been approved, including leave taken outside the UK. However, the letter is quite generic and does not mention any specific dates or periods of absence.

Could you please advise what other supporting documents I can provide to evidence my absences and confirm that my leave was authorised? Would payslips, annual leave records, HR records, or any other documents be suitable?

Please let me know what would be the best evidence to provide.

The document list is not accurate in this instance and unfortunately still shows many legacies of the old Tier 2 rules

I explained that your concerns are baseless, the document list on cohabitation is just a guide and it is NOT based on the requirements under the rules. This has now been repeated many times to you. You do NOT need to worry about this

Also there is no requirement that such employer letter must be produced at all. This is unfortunately the legacy of the old Tier 2 General rules which the document checklist inaccurately still mentions. The Tier 2 General route no longer exists and the rules have changed (it has been 6 years now !!)

I’m not entirely sure I understand this.

My application is a Set (O) application. However, I’m confused by the statement that “The Tier 2 General route no longer exists and the rules have changed.”

If my visa was granted in 2021, does this change affect me and the requirements for my ILR application? I’m finding the terminology quite confusing, especially as I have already been on this route for several years.

Could someone please clarify which rules apply to my situation?

Skilled worker route replaced Tier 2 General route on 1st December 2020. Tier 2 General route was removed from the rules from that point.

You were NEVER granted Tier 2 general at all. It is just that the SET(O) document list still shows the documentary requirements according to the old Tier 2 General rules (The skilled worker rules changed all that but the SET(O) document list seems to have not been updated by the UKVI)

Hi,

I need some advice regarding a matter I recently realized may be relevant to my application.

In 2023, we received a court notice under Section 444(1) of the Education Act 1996 in relation to our child’s school absence, At the time, we had to travel to India due to some family circumstances and responsibilities that required our attention there. It was settled by paying the required penalty. and it never happened again!

Could you please advise whether this would be considered a criminal conviction and whether we need to declare it in my application?

I need to complete and submit my application in 2-3 days time and really nervous about it, so I would really appreciate your advice on the best way to proceed and whether this needs to be disclosed or if any supporting documentation is required.
