I have ILR (previously on a Skilled Worker visa). My wife and child are on Skilled Worker Dependant visas granted in 2024, expiring 19 Sep 2026. They are not yet eligible for their own ILR until 2029 (haven’t completed the 5-year qualifying period). I’m now preparing their dependant visa extension and have a few questions
1. Category to apply under: Since I already have ILR, should my wife and child still apply for a Skilled Worker Dependant visa extension, or should they switch to a different route (e.g., partner/child of a settled person)? I understand staying on the dependant route preserves their existing 5-year clock toward ILR — can anyone confirm this is correct?
2. Length of grant: Will the extension be for 3 years (rather than tied to a CoS length), given I already hold ILR?
3. “Are you permitted to work as a Skilled Worker” question on the form: Since I hold ILR and am no longer under Skilled Worker sponsorship, how should this be answered? Should I attach a cover letter clarifying my settled status?
4. CoS details on the form: My original CoS is now expired/no longer active since I have ILR. Does the form still require me to enter the old CoS reference and details, even though it has no bearing on the outcome? Is there a risk that entering the original CoS length (e.g. 5 years) triggers incorrect fee/IHS calculations?
5. “Work start date / end date as per CoS” field: What dates should be entered here given I have ILR (no expiry date)? Should I use my ILR grant date as the “start” and a date 3 years later as the “end,” purely to get the IHS calculation right?
6. Evidence to include: What supporting documents are typically required in this exact scenario (main applicant ILR + dependants still on Skilled Worker Dependant route)? E.g., BRP/ILR proof, relationship evidence, financial evidence?
