Maintenance Query-Tier1 Migrant in UK, Dependat app in India

Post by ramgsk » Tue Jan 20, 2009 11:36 am

I have a Tier1 General Migrant visa and I am currently in UK for the past 3 months.

Now, my wife is applying for Tier1 Dependant visa from India.

What is the maintenance funds we need to show.

£1600 for her (according to paragraph 29 of http://www.ukba.homeoffice.gov.uk/sitec ... policy.pdf)
£800 for me since I am main applicant and currently staying in UK for past 3 months ( according to paragraph 196 of http://www.ukba.homeoffice.gov.uk/sitec ... idance.pdf)

So, is it
£1600 + £800 = £2400

There is actually an example similarly worked out at paragraph 31 of http://www.ukba.homeoffice.gov.uk/sitec ... policy.pdf.

Please confirm the amount,

I understand if I (Tier1 Migrant) am in India, then I should show £2800 for me, then it would have been
£1600 + £2800 = £4400,
but since I am already in UK, it should be £2400, am I right in this case.

The same post appears twice in the forums, did not got a reply from senior members, so posting it as a separate thread.

Would appreciate a lot if somebody has applied with these funds and got a visa, would be thankful if they could reply.

Comments/Discussions/Suggestions would be quite helpful to me.

hey,

i had the same query and wrote to chennai bhc, they replied saying that we must show GBP2800 + gbp1600 (as the main applicant though visa approved has been in UK less than 12months)

Hope this helps,

Cheers.

the question was really for my kid, thought too much information in the thread would confuse the readers, and kept it brief saying it is my wife

Since I and my wife have visas now, we would be applying our kid's visa after 3 months, I would be in UK then, my wife would be applying my kid's visa here in India.

So, checking whether I need to show

800 for me + 1600 each for my wife and kid

or

2800 for me + 1600 each for my wife and kid

For the second one, I do not have that much money, have to take a loan if that is the case

Anyways, I was mailing BHC, today got a reply from them

"It is not mandatory for the main applicant to show proof of funds after the visa has been issued. However if you wish to show proof of £800 you may choose to do so"

Bit skeptical about it, as I got different replies for the same question earlier, asking me to show 2800 GBP for me.

Looking for any seniors who have applied similarly so that I can know it clearly

oh thats clear enough now.

You need to show GBP2800+1600 for each dependant. I am attaching the emails i received from BHC below, I would suggest you better email them.

1)Dear Ms ,
Thank you for your e-mail. Dependants under Tier One and HSMP transition: must provide evidence of £1600 over the 3-month period. However, we will accept accounts in the name of the dependant and spouse (joint names), the dependant only, or the spouse only, to establish the £1600, providing the £1600 is in addition to funds already shown for the main applicant. It is advisable not to show the same £2800 shown for the principal applicant.
Hope this helps.

2) Dear Ms xxx ,
Since your husband has been issued his visa recently, the £1600 should be shown in addition to the £2800.

Yours Sincerely,

It is best you clarify this with BHC, I would suggest you to ask you/your wife to Call BHC and confirm.

It is wierd that they have a different answer everytime you ask them the same question. Secondly if you get the same response from BHC as previous PLS MAKE SURE YOU ATTACH THE EMAIL ALONG WITH YOUR APPLICATION.

this was a suggestion given by VFS Blr, as they said rules are changing so often that BHC themselves dont know what is applicable.

I have spent over 6months trying to make sure there are no loopholes for my application.

Cheers.
