another question

Post by cupcake123 » Wed Mar 04, 2009 8:44 pm

My fiance is an american citizen and im from britian. We want to get married and the new rules about people applying for marriage visas who must be at least 21 are stopping us.
Is there anyway around this ?
Could we get married abroad and then could I bring him to the UK when we are married?

Otherwise wait...

Hello

They are not stopping you getting married. For example he could come on a "marriage visit" visa, you both get married & he then returns to the US. You just would not be able to sponsor him to come to the UK as your spouse.

The options are:
He comes to the UK using a work route like Tier 2
He comes as a student
You both move to another EU country & then return to the UK using the EEA regulations that apply to spouses
You both move to the US
You both have a long distance relationship on visitor's visas but often apart & then he moves to the UK when both of you are at least 21
Also like Wanderer posted make use of another citizenship that one of you has.

Love will find a way as they say.

What are your ages?

Regards

Checked your last topic, he is 17 and you are 18.

This makes a work route less likely because you need to score points for previous earnings and/or qualifications. Does he want to come to the UK and be a care assisant or chef, which may be possible (still a long shot)?

So on a marriage visit visa we dont have to wait until we are 21 to marry?

He is willing to do any work in the UK.

On a marriage visit visa you don't have to wait until you are both 21, but he would have to leave the UK before 6 months are up, he could not work on that visa and he could not change it to anything else. He would also have to convine the ECO (entry clearance officer) that he would leave the UK before his visa runs out.

Use the link below to see if he would score enough points for the Tier 2 work route:

http://www.ukba.homeoffice.gov.uk/emplo ... r2skilled/

See also the shortage occupation list

Employers who are sponsors are listed here:

http://www.ukba.homeoffice.gov.uk/sitec ... ofsponsors.

It is likely that the only Tier 2 work routes he would be eligible for would be chef and care assistant.

Regards

There are also other options as I mentioned.

To be absolutely clear on the marriage visit visa....this will only allow him to marry in the UK, not to settle as your husband. He would have to return to the US after your marriage and wait until you are both 21 before you can apply for a spouse settlement visa for him to live with you in the UK legally.
