Need Urgent Advice And Suggestions-Please help!

Dear All,

I had applied for TIER1 POST-STUDY WORK VISA. I got refusal after 3 weeks of my application on the grounds of MAINTENANCE. I supplied all the required documents including the maintenance. I have supplied a bank letter dated 14/05/09 which shows that I have deposited a total of 3 lac Indian rupees approx. 4000 GBP on 13/02/2009.My application is refused due to the ambiguity of the BANK LETTER which does not clearly state anywhere that the funds in my account can be withdrawn at any instant of time. The ECO (ENTRY CLEARNACE OFFICER) agrees that the funds have been in my account for the last 3 months but according to him it is not READILY available. They have given a chance of ADMINISTRATIVE REVIEW but now they also instructed me to not to include ANY NEW DOCUMENT/EVIDENCE as a supporting evidence along with it. Without any supporting bank letter, how can I clarify him that I still have 3 lacs in my bank account since 13 Feb 2009. Please please help me in this regard. My bank is now ready to supply me a more clear letter kind as per the requirements. But I wish to know that whether I can attach this letter with the admin. review form as this new letter can dispel his misconception. Will this letter counts in a completely NEW EVIDENCE/ NEW DOCUMENT????will they accept it???Please advice me asap.All my originals are still with them. I went to the VFS visa application centre and one of the employee working in vfs told me that just fill in the administrative review form and send it to them stating that those funds are READILY available to you w/o any doc and should agree.

Thanks for your quick reply mate. Following is the exact wordings of the ECO:

"UNABLE TO CONSIDER THE FUNDS AS THE LETTER FROM BANK DOES NOT STATE THAT THE FUNDS ARE READILY AVAILABLE".

The bank letter which I supplied was actually a FIXED DEPOSIT LETTER.

I had also supplied them with the receipt which I got when I deposited money in my account.

(1)Apply for review with a letter from the Bank that funds are readily available - wait could be 1month to 3months+ (chances of success too are low as admin review just checks whether the caseworker applied rules correctly)

(2) Re-apply

In case of making a new/fresh application a letter from the bank stating the fixed deposits are readily available is enough or I need to maintain funds for more 3 months and then re apply???
Also, to make fresh application I need all my originals so what I can do to get back my originals from the BHC.

Any idea???

and why do you really thinks that the chances are too low and on what grounds you say the waiting times???

Any more suggestions??

(1) If you have already maintained funds for last 3 months, you can reapply immediately
(2) waiting times - based on what ppl report on the forum (search the forum and you will get a sense yourself)
(3) Bleak chances- because Admin Review process just sees if the case worker made any mistake and one is not "supposed" to provide additional evidence (which you would have to do if you chose to go that way). If you have time go ahead....

Dear freind
I really did not understand your 3rd point (bleak chances). Please can you clearly explain it. I am already in my home country soon after submitting my project work back in January and my grad day is 21 July. I know the current waiting times as I have already applied once I can expect the same time with this fresh application.
Do you think that I should apply for a admin review and you did not mention me on how I can get my documents as soon as possible.

The Entry Clearance Officer (ECO) believes that the supporting BANK LETTERS dated 14/05/2009 and 13/02/2009 supplied with the application are not sufficient and ambiguous. I fully agreed with his thoughts and respect his decision. My category falls under paragraph 320(7A). In my case, material facts have not been fully disclosed, in relation to the application. The bank officials did not disclose that I can withdraw funds available in my account at any instant of time because I never asked them to do so. Earlier I asked my bank to provide me with a letter which states that “The funds have been in bank for the last 3 months and that the funds never fall below Rs. 3, 00,000/â€

I think you should be a little less submissive and more assertive. And admitting your mistakes is not a good thing because if things go wrong it will damage you in appeal.

Say something along the lines of the fact that the letters provided by the bank according to bank officials should have been sufficient to clarify availability of funds. However, to clarify the matter further, you have done this and that.

Also that I have fulfilled the requirements for maintenance. However, if you need further information please contact the bank authorities before coming to any negative conclusion so that least time is unnecessarily wasted.

You have to be politve but assertive not too submissive.

Firstly, I would like to ask you that whether or not UKBA accepts FIXED DEPOSITS???THIS IS FIRST AND FOREMOST QUESTION??IF THEY ACCEPTS FIXED DEPOSITS THEN WHY DID THEY REFUSED ME. I accept that the bank letter does not state anywhere that the funds are READILY available.

NEXT I WANT TO KNOW WHAT OPTION WOULD BE BEST FOR ME AT THE MOMENT:

OPTION1: APPLY FOR ADMINISTRATIVE REVIEW WHERE THEY HAVE RESTRICTED ME TO NOT TO SEND ANY NEW EVIDENCE
OPTION2: MAKE A FRESH APPLICATION ON THE SAME FIXED DEPOSITS WITH A NEW LETTER STATING THAT THE FUNDS ARE READILY AVAILABLE AT ANY TIME
OPTION3: MAKE A FRESH APPLICATION AFTER MAINTAING BALANCE (AVAILABLE FUNDS) FOR MORE THREE MONTHS FROM NOW ON (JUNE,JULY,AUG).....PLEASE HELP ME WHAT CAN GET ME SUCCESS????

First of all, there may not be any rule in favour of or against submission of fixed deposit receipt. Clearly such deposits are your deposit and if there is any fixed period for them to remain in the account, the worest that happens to people is that they might be charged a little for withdrawing them prematurely.

You might ask that why should ECO know about it. I would say that ECO do and should have minimum knowledge of such things having been trained about such documents. Moreover they deal with documents on daily basis so that should have this much minimum knowledge.

Secondly, I think your best option is to apply for review for the following reasons:

1. When you give another letter from the Bank, it is not new evidence. It is an explanation of the old evidence; an explanation of something which was not clear to the ECO.
2. The Review is free whereas applying again costs you.
3. If the Review is unsuccessful, you can always apply again.

Frame your letter accordingly. Say that you were under the reasonable impression that it should be common knowledge that Fixed Deposits are withdrawable as and when you wanted. However, you have now taken a letter from the Bank which further clarifies the matter.

Also say that they should contact you or the Bank in case of any confusion.

I know ECOs can be highly unreasonable people at times but you do what is best in the circumstances.

Just to add, of course the funds in the shape of fixed deposit should have been for at least the past three months. But fixed deposit in itself should not be a problem...

Hi All,

Good morning.

I got my Tier 1 general Visa 2 months back and I am planning to apply dependant visa for my spouse and kid.
For the maintenance fund I am showing my wife’s fixed deposit account. When I checked with UK visa help desk they told me that I can show the fixed deposit as proof of Maintenance fund and they asked me to produce the letter from the bank.
I checked with the bank and they are ready to give the letter, but they not have any predefined format for issuing the letter and I was asked to give the letter format.
So if anybody as the format of Fixed deposit letter from bank please share to me .

It is very urgent for me.
