Indian Baby born in UK, Father on HSMP Visa

Hi,

I am staying in UK since April 2008 under HSMP Visa and my wife from May'2008 under HSMP dependent. We are blessed with a baby girl in June 2009. My wife and I hold Indian passports. We have the permission to stay in UK till Mar'2010 after which we are planning to apply for HSMP extensions.

My Query is:
Is it fine if I apply for UK dependent VISA for my daughter when we apply for my HSMP Visa extension or Do I need to apply one now and again while seeking extension? Can my daughter stay without a VISA in UK till I apply for my extension? We are not planning to travel outside the country till our VISA extension.

Till you don't leave the UK your daughter does not need a visa. So it is ok if you apply a visa for her when you go for Tier 1 extension next year.

If you are not planning to go out of country then you dont need to get visa for your baby now. You can include your baby as dependent when you apply for extension.

In case if you want to visit India then before your extension date then you have to apply for visa either here in UK for FLR or in India for EC.

I hope you do not mean that you plan to apply after March 2010, after expiry of your leave to stay .
