Two simple questions:

Post by houman1979 » Fri Dec 11, 2009 10:07 am

Dear All,

I granted Tier 1 General and I have two simple questions:
1-In visa stamp stated "D-Tier 1 (General) Migrant", does that "D" mean something special?
2-As guidance, Tier 1 General migrant cannot work as doctor in training (only in special cases which are not applicable to me), but in my visa stamp this is not indicated as a condition (in my husband's who is my dependant stamp it is stated). Is there any problem or everything is ok? I think embassies are so careful in visa stamps. Have you heard anything that they made mistake in them especially regarding stay condition?

Best Regards

if your husband is your Dependent then I believe the "D" stands for that which is pretty normal

dont assume they are careful always in my case instead of Tier-1 they stamped Tier-2 general and i have requested VFS officer to verify there and she suggested me to write a letter for visa correction and hand over it to her with the passport and she send it back to embassy and i got the correct stamping after 1 week. So this may be valid input to many people here thought of posting here.

Then you suggest ask embassy about or not? I am not a doctor and my field of study is not related to that. In addition, it is their fault and not mine, then do you think it is important to let them know about that?

my visa is for 3 years.

i would suggest you take your passport and photocopy of the visa to VFS office (if you applied in india) and talk to them. They will suggest you how to proceed. Even if it is their fault it will be you who will be facing problems while entering UK at the port of entry. So better first talk to them over the phone and get things cleared.

Thank you for your help. I am applied in Iran and they don't have phone service and I should go there in person. I think that going there is a good idea and dont have any negative effect for me. but I think we are not supposed to know about the shape of visa stamp and their internal regulations.
By the way your suggestion is good.

I encountered a very confusing matter in UKBA site about extending Tier 1 General:
http://www.ukba.homeoffice.gov.uk/worki ... gyourstay/
according to that for extension you should have a visa which does not prohibit from working as a doctor in training!!!!!!!!!!!! Maybe because of that my stamp doesnt indicate that.
Is there any comment?

If this were true, almost no new applicants would be eligible for extension. What you quoted is just a sloppy excerpt from the rules. The correct one is here:

The conditions you must meet to extend your stay if you apply and are already in the United Kingdom

Leave to remain (permission to stay) is subject to the following conditions:

* you must have no recourse to public funds, which means you will not be able to claim most benefits paid by the state; and
* you must register with the police if this is needed by paragraph 326 in part 10 of the immigration rules.

You may not be not employed as a doctor in training unless:

* you were last given entry clearance, or leave to enter or remain, as a highly skilled migrant or as a postgraduate doctor or dentist;
* you were last given entry clearance or leave to remain as a highly skilled worker and that was not subject to a condition prohibiting employment as a doctor in training; or
* you submit a valid Highly Skilled Migrant Programme approval letter, and your application for that approval letter was made on or before 6 February 2008.

If you are already in the United Kingdom and are sending any dependant applications at the same time as your own application, we encourage you to send your application and dependant applications in the same envelope, or you must pay a separate dependant fee.

Thank you for your comment.
I asked British Embassy in Tehran today and they told me the stamp is correct and according to rules because you may work as a doctor in training but dependents cannot do that.
