Dependant ILR status

Hi,
I'm work permit holder, I came to UK in Oct 2005, I will go for my UK ILR application soon in Oct this year. I will need to go for the Live in UK test before my application.
My question is, If my wife who came to UK with me at the same time as depend ant, doesn't have the Live in UK cert, can she still apply ILR status together with me? Or she need to apply for another Visa for dependent for ILR holder?

Normally, for ILR, she needs to satisfy the KOL requirements too, unless you are affected by the HSMP Forum Ltd judicial review judgment of 6 April 2009 (settlement in the United Kingdom).

Hi,
I just wonder to the worst, if my wife can't obtain the test certificate, can she still stay in UK as dependent of ILR holder, maybe she need another different type of dependent Visa (switch from work permit dependent to ILR dependent)? Many Thanks

It would be best if she satisfied the KOL requirements too. Else, I think that she may switch to FLR(M) if you succeed applying for ILR.
