Naturalisation form query

Post by gainvidya » Tue Feb 02, 2010 12:14 pm

Hi,

I am applying for naturalisation based on 5(WP)+1(ILR). Got few queries while filling AN(Adult) and MN1(child) form. We are all ILR holder and my child was born out of UK.

>MN1
>1.1 Please indicate the section of the British Nationality Act 1981 under which you would like the application considered. See Chapter 2 of the guide for details.
>>>is it section 3(1)?<<<<

>What about Section 3 in MN1 form do I need to fill that at all!

Hi gainvidya,

Where was your child born? Section 3 (1) is relevant when a child is born outside the UK and is applying for nationality with the parents, so it sounds like the most likely option.

If you child was born in the UK, then he/she has been eligible for citizenship under Section 1 (3) on the date you got your ILR.

See Page 4 of the MN1 guidance form for details.

In that case you are applying under Section 3 (1).

Sorry I missed your second question. You do not need to fill Section 3.

I applied on an identical basis to yours and thats how I completed my form. The NCS checked it and were happy with it.

Another question on Naturalisation form.

MN1 Form Query>>>>
>Section 4: Good Character Requirement
(This section applies to the child applicant if they are aged 10 and over.)
MY child is just 6 years old. Can I skip the whole section 4?

>Section 5: Referees and Identity :
(One referee should be a professional who has engaged with the child in a professional capacity, such as a teacher, health visitor, social worker or minister of religion.)

I am using the same referee for my child as I am using for myself but he is not enaged with my child in professional capacity, should that be OK?

>Section 6: Consent to the Application:
(The consent of both parents is required for applications made under section 3(5) and 4D and is expected for all other applications.)
<<<<<<<<<<

Form AN query<<<<
Section 1 :Personal Information:
In the last 5 years address I am still living in my current address. What should I put the end date "Till Date"!

1.36 Date and place of marriage/civil partnership:
I got married in 2002 but my marriage certificate says solemnized in 2003. What marriage date should I put? Actual or the date solemnized?
>>>>>
Do I have to fill this section since I am applying under section 3(1)

Thanks in advance.
