Objection on Marriage Certificate in HSMP Dependent Visa194i

Hi,

I would like to seek help and guidance from the forum members related to my wife's UK visa. I came to UK on HSMP visa in Sep 2008. My wife applied for her HSMP dependent visa in Dec 2009 from Pakistan. At that time, she submitted all the paper work including our wedding's photographs and original Marriage Certificate. Our marriage was held on 3rd April 2009. She just received the refusal from the British High Commission against my wife's visa application. The reason of refusal mentioned is as follows:
"You have not provided satisfactory evidence of your marriage to your sponsor xxx. In line with the published guidance, you have provided only the translated copy of the marriage certificate without the original. I am therefore not satisfied that you are married to xxx as claimed. 194 (i)."

This reason is not correct as we have submitted the original marriage certificate with the visa application. Our original marriage certificate was in English as we knew that my wife would be travelling to UK. Therefore, we only used the marriage certificate in English and not in the native language. It seems that the visa officer misunderstood the original English marriage certificate and thought it was a translated copy of the original native language marriage certificate which is not true.

Under these circumstances, it looks like I should lodge an appeal. Can you please guide if I should lodge an appeal or apply afresh? How much time the appeal would take in such case?I brought all the documents of my wife's refusal and the original paperwork with me as I intend to lodge the appeal from UK as I believe it would be fast this way. Do you agree that lodging appeal from UK would be the best option? Should I go through a solicitor or appeal myself?

Just fyi, this is the second time my wife's EC has been refused. First time they raised an objection related to the bank statement saying the bank statement was older than one month. After that objection, my wife applied again afresh. This time, they have raised the objection related to marriage certificate however our marriage certificate is 100% original. I really need your help and guidance to make sure I choose the right option to pursue my wife's visa.

Under these circumstances, it looks like I should lodge an appeal.
First you need to contact the relevant British Mission and ask that the ECM, the Entry Clearance Manager, to review the decision of the ECO who rejected the application.

Make the point as you have posted in this topic, about the marriage certificate being an original, not a translation.

If that does not work speedily, do submit an appeal.

IN PAK THE ORGINAL MARRIAGE CERTIFICATE IS IN URDU LANGUAGE ACCORDING TO THE ACT. ALL THE UNION COUNCILS OF PUNJAB PROVINCE HAVE GOT ONLY URDU VERSIONS WHICH IS CONSIDERED AS ORIGINAL.
IF U PROVIDE MARRIEGAE CERTIFICATE IN URDU (CALLED NIKAH NAAMA) BHC TAKES IT AS ORIGINAL AND WHEN U SUBMIT AN ENGLISH COPY BHC TAKES IT AS TRANSLATED COPY.
