Naturalisation : 5 years

Hi,

I just recently got ILR on 5 years (WP and HSMP rule) and started looking at Naturalisation process. I found following legal requirements for naturalisation.

1. Are aged 18 or over when you apply
2. Are of sound mind, so that you understand the step you are taking (but see below for
those who are not of sound mind)
3. Intend to continue to live in the UK, or to continue in Crown service, the service of an
international organisation of which the UK is a member or the service of a company or
association established in the UK
4. Can communicate in English (or Welsh or Scottish Gaelic) to an acceptable degree
5. Have sufficient knowledge about life in the UK
6. Are of good character
7. Have lived in the UK for a minimum of 5 years before you apply


Now my question is regarding point 7.

I have been in this country since Sept 2003 as a Student but got 1st WP in 22 April 2005.

Can i apply for naturalisation on 23 April 2010 ?

Is it not the case that i have to spend one year on ILR which i just got yesterday?

Please someone can clarify when i can apply for naturalisation ?

You have missed out a very important requirement, that is very relevant to you. That is, you need to have had your ILR for at least one year, before applying for Naturalisation.

So as you say "I just recently got ILR on 5 years", it appears that you have some time to wait.

Also, when you do apply, make sure you were in the UK exactly 5 years before UKBA will receive the Naturalisation application.

John Good to mention 12 months point. I was about to mention this thing. Its very important even for NCS almost all councils have clearly stated for 5 year rule applicant must has 12 month old ILR.
