Hi ,


Currently working in UK (past 2 years ) with a Tier 2 visa , and would like to switch my immigration category from Tier 2 to Tier 1.

In need some clarification to check my eligibility for Points based on past earnings :

I am employed by an Indian Company , and I have been assigned a project in the UK. The work was initially undertaken in India but due to the requirement of the project I'm currently undertaking this role in UK .

In India I get my actual salary (Tax filled in India) and in UK I get UK living allowance (Livex) . While staying in UK part of the salary Indian salary (India Allowance) component is deducted replaced by UK living Allowance.

So while filling my application can I calculate my points using the Points based calculator as follows

1 For actual salary paid in India
Country where you money earned : India
Currency : Indian Rupees
Earnings : 400,000

(UK Salary equivalent : £29,680.00) ( Uplifted by 5.2 multiple)

2 For Living Allowance (Livex) paid in UK
Country where you money earned : United Kingdom
Currency : Pounds
Earnings : 18,000

(UK Salary equivalent : £18,000.00)

( Total Points earned : 25 )

Could someone please help to clarify the same

you cannot use uplift ratio for indian salary while you were in UK.

plesae search forum ... there are few people who have got rejections.

If I got back to india , then and not show the indian salary can I then uplift Indian salary and not use my UK livex

problem is that your form (Tier 1) ... your passport ... all shows you were in UK for earning period ... so i think please don't take risk as it is very obvious.

Since you are physically present in the UK and a part of your indian salary is being credited your account, you cannot use the uplift ratio for the indian salary. You have to just convert INR to GBP using the exchange rate and add it to your UK earnings.That wil be your total earnings..good luck!!

No, you can't because as suggested by pkumar you were in UK during the period of your earnings and your records i.e passport etc will prove the same to caseworkers so pls dont take this risk...
