Pankina judgement and it's affect - Request feedback

As my hsmp extension was refused in feb09..i had more than sufficient funds in my bank account on the date of application but could not maintain them for 3 months...recent Pankina case led ukba to release new guidance notes and ukba has asked for reviewing the refused applications...does this apply to mine as well...i went through appeal process and got refused..then applied afresh HSMP!
all this happened because of immigration rules required funds at the time of application and guidance at that time said maintainence required for 3 months..
please I need your advice on this..
I should have been eligible for ILR in jan 10 if I had got this extension in the first place...
ukba wasted my 1 year and sooo much money! i want to take a chance and apply for ILR explaining whatever happened to me...i was not at fault at all!

Yes, it does apply to you.

This said and if your review is successful, you may still find it difficult to convince UKBA that your illegal status between Sep.2009 to Jan.2010 (overstayer), which reset your ILR clock, was a direct consequence of unlawful decision by UKBA and you must not be penalized for their mistakes.


No harm in trying though. You never know when luck shines on you.

Thank you so much for advising me..
I am meeting a solicitor this week to discuss the same..
As my case last year was also messed up by Malik solicitors and I was not at fault in any way, would ukba still penalise me and not consider me for my ILR?
