Hello All,
I came to Uk on a HSMP visa on june 2010 (after wasting one year of my HSMP). I have admission in MBA programme at Warwick University and I want to pursue my MBA instead of doing a job ( though I am unable to find a good job yet, but i am no more interested in doing a JOB anyways ). I have 2 things in mind which are confusing me:
A- Can I study/do MBA on HSMP visa?
B- If Yes, then My HSMP will expire next year (April 2011) while my MBA will finish in Oct-2011. What should I do? Can I convert my HSMP b4 it gets expired into Tier 4? Can i change or renew my visa into a student visa from inside UK?

Extension of Tier 1 requires you to meet the point-based qualifying criteria, which you'll not be able to fulfil without income. Also, University will not issue a CAS in the middle of the course for you to change to Tier 4 (General). So if you wish to study suggest that you change to Tier 4 (student) before the course commences (time is too short if you plan to join the course in Sept.).

I Just like to know if i can switch to Tier 4 staying in UK or do i have to go back to my home country to do so?
My course will start on 27th Sept to be exact. So i hope I have time to switch to Tier 4. As I am ready to switch to Tier4 right now instead of waiting next year and apply close to expiry of my HSMP. Only problem is that i dont wana go back to my home country to do so.
Though my university people says that i can study on HSMP but they are also aksing what will happen once my HSMP will get expired while my MBA is going on? & whether i have to apply for Tier 4 to complete my studies from within UK or do i have to go back to Pakistan to apply.

Unfortunately you cannot change from Tier 1 (General) to Tier 4 (student) from within the country. See
Can I switch in to the adult student category?.
CAS is what you must have to apply for / extend Tier 4 leave. Will the University issue you a CAS in the middle of the course? Don't think so ..

u know I was in Pakistan when I got admission for Warwick in MBA....then I came to Uk on HSMP visa in June which is valid till 2011 June. Few weeks back my uni mailed me CAS and then I replied to them that I am already in UK on HSMP visa and to join wariwck what should I do with CAS now? As I was being told that one can Study on HSMP with no issues.
Recently they replied me that I can study on HSMP visa so no issue, but then confusion came in regarding, what will happen when my HSMP gets expired during my course as the course finish date is 5th Oct 2011. I m yet to get any reply from Uni but i thought to ask on this forum as well.
For me big confusin is, first they say u can study on HSMP and then when its about to expire at the middle of course u say go back to ur home country and get a student visa to complete rest of 6 months of ur course. If i would have been told by Uni not to come here on HSMP and convery it to student i would have done that from Pakistan?
Aslo UK visa office should consider if some one is studyign a course and is in full time MBA and paying his fee and stuff on HSMP, so they just give him student visa for rest of his course once HSMP is about to expire. Whats wrong in it.
I m in deep trouble now...i have a month left in MBA and i cant go back to Pakistan just to convert my visa. Thats not right. Is there any way i can avoid my visit and get Student visa etc. I hope u understand my position.

No offence, but you can't blame others for your own mistakes:
1. Did the University tell you to enter UK after 1 year of being granted HSMP? And join a course at a time when your current leave will expire in the middle of the course?
2. As an applicant, did you make any effort to know what rules apply to you? Ignorance of rules is not an excuse that you can use. As an applicant it is your responsibility to make yourself aware of matters.
3. Is University an appropriate organisation to provide you immigration advice? Their responsibility towards international students is to be a Tier 4 sponsor, issue CAS and fuflill related obligations, and provide quality education.
4. HSMP/Tier 1 is not meant for people to come to UK to study. Tier 4 exists for that purpose! It is you who now wishes that UKBA/UKVisas bend the rules for you because you are not interested in working at the moment and would rather study and also expect that immigration rules be bent for you to suit your desire.
Had you done some proactive thinking and strategic planning yourself, you wouldn't be in this situation today.
Unfortunately, there is no way out as switching from Tier 1 to Tier 4 is not allowed.

Hi,
You know what the problem is:
My university did mail me that I can travel on HSMP visa and study on HSMP back in feb 2010. I did mail them before coming to Uk from Pakistan that should I convert it to a Tier4 or should I come on HSMP?
Also they did mention that once my HSMP is about to expire i can get Student visa from within UK. Thats the immigration/visa officer's job in his Univeristy's department to guide new coming students from arround the world.
Thats why i came to UK on HSMP visa though i had no issue in converting it to tier4 from Pakistan at first place.
Also one doesnt need to switch from Tier1 to Tier4 becasue one can study on HSMP visa, thats why no need to switch at the first place. My problem is not studying on HSMP as my univeristy do allow me to study on HSMP without any issue. My only problem is getting student visa once HSMP gets expired and there is nothing mention of such sort on UKBA rules.
So in short i did consulted my univeristy before leaving my home country. In the end thanks and thats why i am asking my univerity to guide/help me as i came here on HSMP becasue they mentioned so. My only point to ask this confusion on this site was just to clear my confusion in advance in parrallel with univeristy's immigration office.
What if some one comes on HSMP and finds it hard to get a job and instead of wasting his/her time go for furthur studies to improve his chances in this market? I think its perfectly legal and right and i am not asking UKBA should change their rules for me but i am only asking them to clarify their rules a bit. As to me if they r allowing some one to study on HSMP then they should allow him to get student extenion once his HSMP is about to expire from within UK (they havent mentioned any such rule as per my findings).
I did try to get rules regarding study on HSMP visa from UKBA site bit there is no clear thing as such.
