Hi,

I am wondering if anyone can explain this for me. Our ILR was rejected for this reason.

Please note that with effect from 22/11/10, the fees for the purpose of your application have been subject to an increase. Applications made on or after 22/11/10 will need to be accompanied by the new fee, even if made on the current version of the application form.

The Immigration and Nationality (Cost Recovery Fees) (No.2) Regulation 2010 and the immigration and Nationality (Fees)(No.2) Regulations 2010 specify the fee which (Subject to a small number of exceptions) is to be paid in connection with an application for the purpose for which you have applied. The fee specified for an application made on this basis was £840. However, as advised above, following the increase in fees on 22/11/10, the fees specified for the purpose of your application is £900.

The specified fee has not been paid in connection with your attempted application which you made by post on 30/09/10. We do not consider that an exception to the requirement to pay the fee applies in this case, and therefore your application is invalid and we are returning your documents.

The passage next to the box ticked below provides more detail about the failure to pay the specified fee and the steps you should take to ensure you make the correct payment when returning your application.

x You have not made any payment and have not completed the payment page of the application form. Details of how to pay the fee are given in the guidance notes within the application form.

Questions I have are:-

1. We have proof that the payment page was submitted completed in full with a digital copy. The home office kept the payment page. We have booked in for an emergency in person application do we show them this letter?

2. The above does this mean anyone who applies for any visa is subject to changes in fee and application form therefor make that application invalid at time of processing. We applied in 30th September 2010 based on those prices and application form? How can the home office change the prices for us it’s not our responsibility to get unknown future predictions right.

3. When we go to apply in person do we mention any of this or go in with a fresh new application and leave this matter aside.

My partner and I have exactly the same problem. Could the original author or someone with any knowledge of this situation please reply? Thanks a lot for any assistance
