Hello people
Could someone please help me out with the following predicament I am facing. I have been working for 11 months on a TWES permit in the UK, I was then made a few job offers from companies I had applied to. Towards the end of my TWES one of the companies whose job offer I accpeted mad ea WP application on my behalf which was rejected yesterday saying that as I was on a TWES I should live out of the country for a year. I am aware of the rules relating to TWES but I also knew if one made a good application it was possible to obtain a switch as quitE a few friends of mine have managed to obtain a switch. The company says it made a normal WP application as it normally does showing that the position was advertised etc etc and that I was the best suited candidate etc etc. The Home office on their rejection letter said that they wanted to know how I would add value to te business or something on those lines. I am trying to get the company to apply again or ask the 2nd company who offered me a job to make a WP application for me. Could sombody please give me some advice as to what I need to do different this time round.

Very tricky one - am sure other forum members will help out. Presumably you are not eligible for HSMP
If all else fails try swicthing to Student and then a pply for WP employment later

If there is a specific letter from HO, you certainly should discuss its contents with your employer or, perhaps, with a lawyer -- it doesn't seem an outright refusal, but something with conditions attached.

It appears that you being on a TWES was an issue is so far that Work Permits UK were not convinced to exercise discretion on the basis that you were the best candidate relative to the resident labour pool (RLP) as per Tier 2 applications. Unless we can see all the paperwork including job description, details of those interviewed and why those in the RLP were rejected vis-a-vis your skill set then we can't really help. Ask your initial sponsor to address this issue in an appeal or if not willing to proceed can you realistically assess your skill set because this problem may come up in a new WP application.

Thank you all very much for all your advice. Well I havent yet seen the refusal letter from the Home Office but the employer told me it said the application was being rejected because it was TWES permit being converted to a WP, as the rule stands the candidate must spend 1 year outside the UK. I know a number of people who had theirs transferred/switched.
Is this more a problem with proving I am the best candidate for the job in terms of Tier 2 applicatioins because I for one certainly think the employer dod ebrything right in terms of advertising the job, job description and the candidates they interviewed infact they also went to universities for the opening so if this is not the problem what could the problem be !!
I am meeting a solicitor on Monday, any tips on what I should discuss with him with regards to a new application with a new employer.
