Query-- Spouse case Please help me in this Tricky Issue

Q: I am a British citizen by birth and never lived in UK after my childhood. i am a British PP holder aswell. I am not possessing Britsh national Tax number neighter do i have the insurance number. My husband is an Army officer in Pakistan and Iam living with him in Pakistan from last seventeen years. Now my husband is retiring from Army w.e.f Dec 2006, therefore we want to settle in UK after the retirement. My husband would be Having handsome amount of money on his credit after the retirement which would be sufficient for establishing a business in UK. Offcource we would not ask for the public fund. Now what I want to ask that , how my husband can apply for the settlement visa/resident visa on the spouse behalf while Iam living with him in pakistan and want to proceed along with him to UK. We have a son also aging 10 years who also is a British citizen and also possesses a British PP. My brother is already settled in UK and owns a house there. He is ready to accomodate us in his residenence. Now kindly guide us so that my husband would definitly get the settlement visa, thereby we could move together to UK and settle there. Once again I want make it clear that we will not ask for the public fund in UK and will rely on our on accounts for the settling purpose. Your guidance will be higly obliged.

Tariq, based upon what you post I don't think there will be much of a problem your husband getting a spouse visa. In fact because the two of you have lived together outside the UK for at least four years, instead of him getting the normal 2-year spouse visa they should issue him with ILE ... indefinite leave to enter.

As always it is a question of supplying good evidence in support of the application. Temporary use of your brother's house is a good idea but do prove that the place will not be defined as overcrowded should the visa application be granted. This topic (click) will be useful to you.

Once your husband gets to the UK, that will start the clock running on a possible Naturalisation application. That is, three years after arriving in the UK he would be eligible to apply for naturalisation as British.
