Itemised mobile phone bills and land line bills showing the spouses' phone number dialled directly is good evidence of communication.

Bills showing an access number being dialled is not deemed to be evidence of communication because it doesn't prove the spouse was contacted. Although you could try contacting the calling card company to see if they can provide you a call itemisation although this is unlikely. Cards and access numbers have been accepted in the past but less so nowadays.

Although more expensive, the evidence of communication is much better if you direct dial.

Money transfer receipts are always good.
I sent off my orange bills they showed the local access number dialled.....they didnt object.. i did send text messages directly i found this cheap lol

Salam,

In court do they accept proof from an actual mobile phone? i.e if I was to show actual text messages my hubby sent me which are dated before the refusal. Is that accepted?

I wanted to know since my hubby's visa was refused back in September 2011, we have appealed as many of your are aware. I am now gathering evidences to prove that my hubby and I are in a genuine relationship etc. We are collecting recent bills, emails almost everyday, greeting cards as time is getting near etc just incase I have to go hearing. I wanted to know do we present these evidences/proof in court? (These evidences are dated after refusal.. as I dint have them before).

How does the procedure work?

I would advise you to submit as much evidence as possible.. my husband and I submitted calling cards and that went against us. So I would say..

Skype
Emails
Letters
Greeting cards (KEEP ENVELOPES TO SHOW STAMPS)
Money Transfer receipts
Itemised billing
Photographs of wedding and AFTER like honeymoon pictures showing you together!

Anything you feel can prove this or is relevant, just add it in! Better to be safe than sorry! I wish I would have been advised before I submitted mine.

How does the procedure work?
hi exquist33- before the date shown on the notice of pending appeal. you will either get a letter called notice of withdrawal or one which gives you a notice of a hearing.

generally if they have overturned the appeal, the ECO will contact you within 3 months of submitting the appeal otherwise you can assume you will have to go to a hearing.

if you get the notice of withdrawal of appeal. they will contact ur spouse in pak and tell them to submit their passport and tb certificate. Usually they send a 'call letter' by post or email

OR if you get the hearing date notice. then on it you will get a date for the hearing and beofre five days of this date you sill need to submit a 'bundle' to the court which is baiscally informing the court what you will be arguing in court.

I think the only thing you can do is wait. Or contact Leiceister AIT. They shoudl have some information about whats happening with your appeal.

I'm flying to Pakistan this week and I'm taking all all my paperwork so I can submit my wife's application.

I think I have everything I need but I have not got the following:

- affidavits from UK nationals affirming their knowledge of the relationship and belief that the relationship is genuine. (Is this required)?

- Covering letter from sponsor - No need as all the information is in the application form.

- Signed Sponsor’s Declaration? Only heard about this today, what is it? and do I need it??

Any help would be much appreciated.

@ Visa321 Hi, when I applied for my hubby's visa, I went to see a solicitor whom helped me put my documents together. I was told I need a Sponsor Declaration, it basically said that I wish to sponsor my husband and how much I earn etc. I then got that from the solicitor which I signed infront of solictor. I don't know what else goes in the Sponsor Declaration. Therefore please check with your solicitor, just to be on the safe side. Good Luck with the application.

@ Okara87 or anyone else that may be able to help me, when we receive the court hearing date, the 5 days before.. how do we get the documents to the court? Do we post these? Does this include all the evidence that we have accumulated to present in court?

I've got:
-certified copy of my passport
-wage slips
-bank statements
-letter from employer
-housing report
-land registry
-letter from parents about accomodation
-photos
-itemised phone bills
-phone cards
-emails
-sms markaz printouts

Am I missing anything?

Do i need a sponsors declaration? If so what goes in it?

I've also heard you only now submit the origional file of documents and dont need to submit a photocopied file, is that correct?

I think you should avoid adding the phone cards to your application, if you have other means of communication proof such as itemised bills stating your partner's number and any other means of communication i.e. sms, email etc.

This is to avoid giving ECO a chance to question these cards as they do not prove that these cards were used to contact your partner.

Just a thought.

Yes I believe you do require sponsors declaration, I do not have a template for that but I guess other senior members of the board must have one.

The thing is, I use phone cards to call my wife, and the itemised bills show the phone card number, hence why I'm also submitting them.

the 'bundle' can be posted. it should contain all the points you will argue in court, so yes all the evidence. You just need to wait for the notice to come through and it will explain the whole process.

@naila- as i never received the document, i was unsure- my mistake :(

Salaam Bro

I think your list is complete with the exception of the following:

P60 - This is a must document as it proves that you have paid your taxes etc. You should have this as it would have been sent just after the tax year in April 2011. If you need a copy you will need to contact your tax office that your employer is registered with. Your should be able to find the contact details on your wage slips.

Accomodation Letter from Parents - Make sure this has been certified by a responsible person. This can be a solicitor/accountant etc.

Sponsor Declaration - This letter is normally done by a lawyer should include the following:

Your Name,
DoB,
Who you are sponsoring and under what category visa (spouse - entry clearance.
Spouse Name
DoB
Address where you will keep your spouse
A declaration that you have sufficient funds to support her and that you will not resort to any public funds etc.

Thanks for your email bro, I've not got a p60, but I've got a p45 because I recently changed jobs and the p45 shows all the taxes I have paid so that should be sufficient I think.

Accomodation letter from parents to be certified? I've never heard that before. Its just a simple letter from the house owner signed by the house owner isn't it?

Bro, what you got to remember is that you are trying to prove to them that you have sufficient space and a house to live in.

To be fair anyone could write a letter and forge a signiture and that is likely to cast some doubt in their mind. All you need to do is get it signed and stamped by a lawyer and a statement to confirm that this letter has been signed in his presence of you and when your parents signed the letter.

Your better to be safe than sorry

Aye I get what you're saying, I've got an official housing certificate which shows that the house is not overcrowded and that there is sufficient room for for wife. But I get what you're saying, I'll get my solicitor to stamp the letter.

These two are different.

There is an accommodation report (normally conducted by an estate agent). This confirms the size of the property and that property will not be overcrowded etc.

The second a Parent declaration to confirm that they are happy for you and your spouse to reside with them: RENT FREE, as they are the owners of the property. This one has to be signed infront of solicitor and certified by the solicitor.

I was told this at the time I submitted our initial application by a solicitor, it was stressed that the above were both required.

The letter I gave just had my father's signature, and i got a copy of his passport attested which had his signature - the attesting can be done by any professional person i.e. doctor. I used that to supplement and correlate with other supporting documents i.e. housing inspection report and land registry.
