10 years long residency student visa

i am in uk on student visa from 25th may 2002 to 29th april 2012(visa finishing).i am an mba student but i couldn't finish it in time so my uni asked me to retake. but i want to know as on 10 years rule i can apply 28 days before,will it apply to me or i have to extend my visa again.as my wife and a boy 0f 4 years who born here with me and there visa finish same time of me.can the apply with me 10 years rule if elegible.what will be the best option please let me know.I have the 28 days eligibility to apply but i don't have full 10 years visa( 9years 11 month 5 days).do i need to extend my visa again???????????

Please search this forum there are many threads similar to your case.
You can apply for 10 years Long Residence before your current visa expired if no gaps but suggest do Subject Access Request ASAP

Please let your family apply for FLR(M)

You may apply for ILR 28 days prior to the completion of your qualifying period.

If your wife is not eligible, then she may switch to FLR(M).

Rejected: 10th july 2012 ( money related ussue)
But nothing was wrong
Then fresh applicatio made: 27th september 2012
Biometric: 30th nov 2012
Got a letter from home office to send my life in the uk certificate as they lost it.
I did the liuk exam again and send it to them 1st week of april 2013.

And finally got a good result.

After almost a year.

But I have a question to ask when I applied I applied flr(0) for my wife. And my son as there visa was expirng same as me.i gat letter from home office to apply flr( m)for my wife now.

Can you help me pls do I need to pay the fees again and does she need to do her
biometric again.do I have. To send bank statement, pay slip etc again

It's a pity that your wife didn't follow our earlier advice by using the correct FLR(M) form in the first place.

Fortunately, it seems that they have not yet refused her wrong application, but gave her the opportunity to vary it to FLR(M).

If your son was born in the UK, then he may skip the leave to remain application and register for British citizenship directly.
