ILR Application [Spouse] for wife of British Citizen

Post by RajSharma » Sun Dec 18, 2011 5:29 pm

Dear All - I am British citizen and my wife was given initial 27 month VISA which expires in March.

1. Does she need to give "English language test"? She already has IELTS certificate.
2. How early can we apply for ILR?
3. Do I need to provide my bank details to show proof of funds? We both are working and have full time jobs in private sector. We have our own house.

Your wife needs to pass the Life in the UK test or complete an approved ESOL course with citizens content before applying for ILR. An IELTS certification won't be acceptable. The Life in the UK test (KOL) isn't a test of the English language. It tests the applicants knowledge of British life...customs, social history, laws and politics. If she hasn't started to study this, she should do so as soon as possible.
She can apply no earlier than 28 days before the 2nd anniversary of her arrival in the UK...and no later than the current visa expiry date.
You will both have to submit your bank statements and pay slips to cover at least the previous 3 months.
Don't forget you also have to provide proof of joint address covering the 2 years.

Thanks Casa for your response.

Is there a minimum fund we need to show in our accounts? It's not an issue but I will just like to know the level to show.

Also, we are flying out on short holiday for 2 weeks, her VISA is valid for another 2 month, is this OK or will she have problem getting back to UK?
