Application without passport?

Application without passport?

Hi guys!
My application was rejected in December on the basis of failing to provide my birth certificate which was lost at the time. In the rejection letter they stated that my passport is being held at the regional case ownership unit. I tried contacting the unit, but was unable to get hold of them. Upon contacting the UKBA they gave me another number for the unit and said that if I contact them, I would have to start making plans for my departure.

My institution assured me that I should stay in the UK and make an application regardless (but without attaching the passport).
Has anyone else's documents been retained? And do you think an application like mine can be successful (without the passport)?
I'm afraid they might reject me again for not attaching the passport :cry:

1. U need to explain u case in detail as wat u say does not make any sense.
2. If you did not provide u birth certificate and HO rejected u application then u either get all the documents back (if still has a valid leave) or right of appeal if u leave was expired.
3. U r saying that u did not provide u birth certificate hence u application was rejected but HO retained u passport.
4. Retaining passport is a totally diferent case which means that HO is saying leave the UK and produce ticket and then contact the unit for your passport.

My previous application in the UK was rejected in April 2011 (my leave to remain expired then) and I was given the right to appeal. I have appealed with a rights&advice officer from my uni and unfortunately the appeal was dismissed.
I made a second application in the UK and was once again rejected for not supplying the birth certificate. In the decision letter it states that I do not have the right to appeal and my passport is being retained (which I guess means that they're telling me to leave the country).
The advice from uni is that I should stay and apply again. The solicitor I contacted advised me to go back to my country and apply from there. I am lost :cry:

1. Now that makes a sense.
2. Go with the advice given by the institution as these people deal with these cases all the time.
