Tier 2 ICT Short Term extention

Post by scorp.abhinav » Sat Mar 03, 2012 9:25 am

Hi,

My visa is getting expired on 10th July'12. Please let me know if there is any way to extend Tier 2 ICT Short Term visa.

My salary is a bit lower than 40k mark so I can't go back to India and apply for Long term visa. :(

Regards,
Abhinav

Dear Scorp.abhinav

If you are on short term ICT once that expires you will be subject to a 12 month cooling off period where you must leave the UK before you can return in the same category.

Hi,

Isn't the new guideline released on 14th Feb'12 (article 29) permits to extend for another year while staying back in UK?

Article 29 "You can apply to extend your stay for the maximum amount of time allowed for your specific sub-category".

The maximum length of stay in your sub category "Short Term" (ICT) is 12 months, You are then subject to a cooling off period of 12 months where you cannot return to the UK in the same category.

Article 29 would refer to (for example) If you were on a Long Term (ICT) you can extend after your initial 3years and 1 month(providing you pass English test) for a further 2 years bring the total Leave to remain to 5 years.

You could leave the UK and come back in under Tier 2 general possibly, depending on a number of factors.
