Help Please!!

Post by Jaylith » Mon Feb 06, 2012 10:55 pm

Hi All.

I am looking for some guidance/advice/assistance please if possible!!

I would like to inform you of what happened to me and hope that you are able to try get a resolution for me some how.

I applied for a Tier 4 (general student visa)last year March to study at Fulham and Chelsea College which was a trusted college and recognised by the UKBA on their list of trusted sponsors. I received my visa with the right to work 20 hours a week during term time(unlimited during vacations) and attend classes 15 hours a week.I adhered to my conditions given to me,had the 7200 pounds in my account as stipulated by the UKBA and had paid a full year of my course fees,it was my intention to use my 20 hours work hours to pay for my second year tuition fees.

I arrived in the UK on the 7th of June 2011 and attended lectures from the 13th,it was on the 29th of July 2011,that the college decided to close and stop trading, taking all the students money from them and leaving them 60 days to come up with more money to apply for a new visa and find a new college. We sent numerous letters to the awarding bodies and the UKBA to make them aware of what had happened to us,as the college didn't inform any of them.

I had managed to find a new college and borrow money from all over to pay my tuition fees in order to enable me to stay in the UK,with the mind set that I would still be able to work and study and maintain a decent standard of living, and be able to pay my course fees back to those that lent me money.

I did a bit of research into the UKBA and colleges and found that if I am studying a degree course,I would be entitled to the same conditions as my previous visa, however,I received my new Tier 4 (general student) visa and was given no working rights.I phoned the UKBA enquiries and quiried. My new visa and was told by the lady on the phone that if I am studying a degree course I should be entitled to work rights,I then sent a letter back to my case worker and was told that there is nothing they can do to help me as the regulations had changed. I had my 7200 pounds in my account yet again and that is to cover 9 months living expenses in London. My current visa and course is 2 years long and expires in February 2014.

I decided to study at London School of Commerce,a degree in business and management and therefore was relying on my conditions which I was only entitled to for about 2 months to remain the same,as it is a degree course and the awarding body is the University of Cardiff.

I hope that you are able to help me in some way to change the decision of my rights to enable me to work my 20 hours a week during term time and unlimited work during my vacations.

Regards

First of all I would like to say, this is your punishment why you choose UK as your study destination. Since 2010, almost every education website providing negative views to changes in UK student visa laws including UK own universities. Many of overseas education consultants warn students to avoid going to UK as international student coz laws do not favour them anymore. High rate of unemployment, no post study work permit, no work allowed, very high visa fee, costly living, university fee increase, bla bla bla..these are the signs for a sensible student which clearly says that UK is no more a good destination for international students. If you still choose to study in UK, this is yours fault.

Anyways, if your CAS issued by LSC, you will not be able to work for a single hour.

According to Tier-4 law, a student can only work if the CAS issued by Higher Educaton Institutions (HEI/UK Universities) OR Govt. FE College. For HEI, work allowed will be 20 hours per week and for Govt. College, work allowed will be 10 hours per week.

As you still want to study in UK, I will recommend you to join London College of Accountancy. They are offering same degree courses with comparatively low fee and issuing CAS from Anglia Ruskin University which is an HEI according to Tier-4 law so you will get work permission accordingly.
