ILR eligibility and Tier 2 renewal

Hello guys,

I have got a few questions I was hoping someone could answer.

I came to the UK to study in 2003. I graduated in 2007 and have worked with the same employer since 2008 in the same role. I am currently on the tier 2 visa which expires this October. My questions are: how soon before it expires can I apply for an extension and will I need another COS from my employer?
And will I be eligible to apply for my ILR under the ten year rule in 2013 or has that category been scrapped?

If settlement under (10 years) long residence category continues to exist when you complete the qualifying period (2013), then yes.

As for Tier 2 extension, you'll need a new CoS from your employer. Read also Tier 2 policy guidance.

Thanks sush, one last question? How soon can I apply?
I want to start chasing my employer for the CoS as soon as possible.

As long as you submit a valid leave to remain application before 23:59:59 hours on the date of expiry of current leave, you'll be fine.

Read the policy guidance and get all the necessary documentary evidences arranged before then.
