My US friend is married to a British guy. She has been in the UK for 6 years and has a professional job. She married a British guy just over two years ago but unfortunately it isn't working out. She wants to leave him but he has threatened to have her exported back to the US - what are her options?

He cannot have her "exported" back to anywhere. The only thing he can do is to inform UKBA of the breakdown in relationship and that he no longer desires to remain her sponsor. That's it! Nothing more!

What UKBA may do with your friend's remaining leave - let it be or curtail it - is something that your friend's husband has no influence on. That's UKBA prerogative - and UKBA's only.


As for her, she should check with her employer with they can sponsor her under Tier 2. If they can, she will need to apply for entry clearance from outside UK as a Tier 2 migrant. Alternatively, she should check if she qualifies for any other PBS category.
