Hi All,

I tried searching through the forum pages for this specific query but couldn't find much information, so thought I would start a new topic.

I am sorry to bother any Admins in case this is already being discussed somehwere else. Please excuse me in that case.

The query is as below:

If someone is in UK on Tier-1 or Tier-2 or PR and he/she applies for a depenent visa for their wife/partner/fiancee, who in turn is a doctor or someone studying medicine, would this depenent visa have any restrictions, as in place, in terms of doctor in training or dentist training etc, which is normally applied to Tier-1 visa. How long would this restrictions be in place and what are the opportunities to pursue the profession or carryon the practise.

I hope a few of us know what I am trying to say here.

PBS dependants can't work as doctors or dentists in training unless the applicant:

•has obtained a primary degree in medicine or dentistry from a UK institution that is a UK recognised or listed body, or which holds a sponsor licence under Tier 4 of the Points Based System; or

•is applying for leave to remain and has, or has last been granted, entry clearance, leave to enter or leave to remain that was not subject to a condition restricting their employment, whether that is employment as a Doctor or Dentist in Training or otherwise, and has been employed during that leave as a Doctor or Dentist in Training.

How long does this restriction apply ??
What does 'primary degree' mean here ??

Does this mean that if a dependent comes to UK with restriction, they can
take up a study course and once they finish it they can work as doctor ??

What happens once the dependent has lived 2 years and obtained a PR ??

It applies in the case of PBS dependants (and not to people who have ILR ) and has no time limit unless they met the requirements for the stated exceptions to this.

Does this mean that if someone comes as dependent of a person who holds ILR, they won't have this restriction ??

What if the dependent person takes the UK qualification to register as a doctor while they are in UK ?? Would they be able to remove restrictions on their next extention ?? or When they apply for indefinite stay ??

It applies to PBS dependants. Dependants in settlement immigration categories have no such restriction.

Just one more thing, does this 'doctor-in-training' restriction mean that a dependent can work as a doctor ?? as far as it is not not any kind of training...

PBS dependant with such endorsement may work in non-training posts (e.g. - staff grade, trust grade, LAS, clinical fellow, etc.).

Thanks for the information so far. One clarification please.
Does it mean spouse of Tier II ICT, who has qualified as a doctor in UK, can still work in non-training post only and not as a qualified doctor.
I am sure dependent spouse of Tier II ICT are allowed to work in fields other than medical profession.
