Switching from Tier 1 (PSW) to Tier 2

Switching from Tier 1 (PSW) to Tier 2

Hi,

I am currently on post study work visa (Tier 1) and that is about to expire in 6 months time. I have been employed by a university to work on a project (duration 4 years). I have been working on the project for 2 years now. I need to know the correct procedure of switching from Tier 1 to Tier 2. Some one told me that the university needs to re-advertise the job to meet the resident labour market test and I have to re-apply for the post. However, I passed the interview initially when the job was first advertised.

Also, I read some where that I can switch from a post-study work Tier 1 to a Tier 2 visa without the employer needing to prove that they cannot fill the job with a UK citizen (If I have work for a continous period of at least six months immediatly before the date of my application. Could some one please advise me regarding this. Also, I have been in this country legally for 8 years.

Your query is too generic. Suggest you read the guidance on Tier 2 properly.

Yes you are right they don't need to do a RLMT since you are switching from PSW and worked with them for 6 months. Make sure your company (University) is registered with UKBA and willing to provide you with a COS. You must also meet the salary and English language requirements. See the code of practise and Guidance. This is been discussed many times here. Search in TIER2 section.
