Spousal Visa

Post by travelerzee » Sat Jun 09, 2012 6:30 pm

hello,

I have tried to search for the answer to this question on the forum, but cant seem to find it. apologies if i've missed it!

I am applying for a spousal visa via the premium service. I have been working in the UK for 1 year and earn a basic salary plus commission- hence i earn a different amount each month.

on the application form, it asks: "what is your pay each month after income tax and other deductions"

i am not sure what to put...

Do I put my basic salary OR the most resent basic + commission salary OR an average of what i have earned over the last 12 months?

Average. It does not have to be exactly to the penny or pound.

Make it clear in your answer that you are talking about an average salary.

it should be OK as long as you make it clear that this is an average amount.

I have been working in the UK for the past year. Will these changes affect applications from inside the UK as well?

1. 09-Jul-12
2. What is your current immigration status?

i'm currently on a Tier 1 visa.

i am really confused as to what i should do?!? i am thinking of applying via post. if i do that, then:

-if i fill in the application online, is that the date that is taken into account?
-will i need to wait for a letter from the UKBA to get my bio metrics? wont that delay my application date?

i really cant believe this is happening! i booked my appointment months ago and now, less than a month before it, the rules change!!

In such case you will be subject to the new rules if you apply after 08-Jul-12.

Date of application (in-country application) is determined according to immigration rule 34G.

I doubt i'll be able to get an earlier appointment anywhere in the country at this late stage! i booked my appointment via phone, so i have not filled in the application online.

The literature says if i complete my application online and pay before 9th July, my visa will be granted on the current visa laws. but can i do this if i already have a premium appointment booked?

your replies will be greatly appreciated! i am sooo stressed with these changes!! :(

I believe that when applying online (and paying online) one needs to book an appointment at the end of the application process. I am not sure if a pre-scheduled appointment can be used in such a scenario.

Best to check with UKBA or wait for other responses.

i have another question. i think the nerves and stress are getting to me and i'm being to be paranoid!

just to confirm,
1) if i post my application before 9 July, my application will be considered under the current rules? (even before a payment is made)
2) how will the payment be taken? do i just send the completed payment form with my postal application and the UKBA will take the payment? or do i pay in advance?
3) do i still need to fill in the application in online? (i remember having to do this for my Tier 1 visa)

I'm sorry if these questions seem silly, but they are really making me nervous. i want to make sure i have all the bases covered!

1. Already answered.
2. Read the FLR(M) form. IMHO, pay by banker's draft or postal orders.
3. No.

anyone???

also...we currently have a rolling tenancy agreement for out accommodation. our official tenancy contract ended in May 2012 and are on a 2- month rolling contract. Do we need to get a letter from our rental agency confirming this?

1. Bank statement - as recent as possible.
2. Tenancy agreement - A confirmation from landlord/management agency will help.

Employment is not a requirement for FLR(M) application.
And you are just changing jobs, nothing more!

Question about the bank draft:

I went to the bank today and they wrote out a banker draft cheque (it was not printed on the cheque, the clerk hand wrote it). Is this normal? I thought the cheque had to be printed??

Who should it made out to? On the payment guidance document, it says:

"Banker's draft (payable to Home Office)"
But further down the page, it says: "You must make the cheque or postal order payable to Home Office Leave to Remain"

I’m a little confused...
