Hello all;

As promised, I am making every one aware of my hearing which was on 10-07-12, It got with hold, reason for this is that home office/ukba agency say we were not aware of your new EEA application, our decsions to refuses your applications was only up untill when you were single, but since your decsion for eea application is pending, its better you (applicant) with hold your application by consent. Am i making sense?

now they will consider my application again on the basis i have spent 10 years in uk, plus now my application is pending with eea.

where do i stand? now,please see my other posts to get the better picture, my solictor said its a postive sign,

I thought, I should write the same wording what the home office solictor wrote to my solictor. To make more sense.as to what I am asking from you.

Is the following letter a postive sign from ukba/home office?

Please do advise me of the following letter.

"I write further to your letter of 4 july 2012.

My client instructs that she does not agree to an adjournment of tomorrow hearings.

Aas you note, your client circumstances have changed since he brought the judicial review. He has since submitted an EEA application on the basis of a claimed relationship to a french national. This application has not yet been decided. My client was not made aware of the claimed relationship until April 2012 more thean three months after her decsion letter of 16 January 2012, which was the basis of change in your client,s judicial review. As such it is my client view that the judicial review is accademic and ought to be withdrawn.

I have enclosed a consent order reflecting this postion. If this is not agreed today, both parties will incur the expense of attending court tomorrow where we will make the same argument and also request our costs.

I look forward to hear from you as soon as possib.e/

PLEASE DO ADVISE ME OF THIS LETTER. AM I LIKELY TO GET A VISA NOW? WHAT DO YOU THINK? Is the HOME OFFICE/UKBA scared to fight the case in high court since they now my application for marriage (eea) is pending?

it doesn't mean you are likely to get a visa, what they would do is look at your eea application and if they believe you qualify they will grant your visa but they can still refuse you as well. Them withdrawing is not a guarantee your visa would be granted

Even I had this in mind, but I am concerned which visa I will get, because I have been in uk from the age of 14 to 24, I heard there is a law or scheme which say " chilld who came to UK less then 18 years old" should be granted a Discretanory leave for 2 years.

But my application has been refused many times by home office, recntly my judicial review refused, that why my case was in high court, in the mean while i got married to a french national. therefore my case is;

will i get 2 years discretany levea

or 5 year resident permit

or any sort of other visa/// please let me know
