One way to retain residence of non-EU married with an EU national is:, their marriage must have subsisted at least 3 years before divorce is initiated, and of that 3 years one must have been spent in the UK!

When exactly did you marry? When did you enter into th UK? From what you previously wrote it seems unlikely that you could retain your right of residence as a ex eea family member?!!!

Hmm, I see. Thank you ciaramc for the advice.

Yet, may I ask... I have been in the country since June 2004 (with short breaks) on a student visa. Can I, in June 2009, apply for an ILR?

No, five year stay if on Work Visas, you would need 10 years on student visa to qualify for ILR.

Besides, I think when you applied for a RC under EU rules, you effectively terminated your student visa, which was under the UK rules.
