Tier 1 (G) extension

Hi All,

My current Tier 1 (G) visa expires in feb 2013 so I am planning to renew my visa however caught up in a tricky situation whether to put in for extension or not.

Background:
I am currently on Tier1(G) visa which was issued in 2011, based on my income for fiscal year 2010-2011 , points based system.

Originally when I applied for Tier1 (G) I showed self employed income for fiscal year 2010 to 2011. Paid taxes for full amount what I have earned.

After 2011 I stopped self employment at the time I took time off focused on my job learned new skills to improve my career prospects, it's safe to say I am in a better position now in my career.

For fiscal yr 2011~2012 I have only paid for salaried income which is little less than 35k.

In Aug 2012 I have decided to start doing self employment along with my full time salaried employment and so far I am able to make decent living.

My current earnings include salaried (PAYE) income and partly self-employed income from my own company.

In summary now
I have paid full tax for 2010-2011 (> 35K)
During 2011-2012- no self employed income and tax only paid for (=29,500)

2012-2013 self employed + salaried income (>35k)

If I apply for Tier 1(G) renewal in feb 2013 showing my latest 12 months income (>35k) as proof of earnings in theory all should be fine but mu biggest fear is does home office have right to reject my application citing I have not met 35K for the period 2011-2012 .

I am not sure how they actually look in to this, thing what I hate is they charge 1800 £'s for visa application/appointment, spending that money I don't want to get disappointed, rather I would not spend that huge amount myself and get my employer to sponsor my visa under tier 2..

Just wondering if you guys could through some light on this for me please

previous years earnings dont matter, all you need to show is you have enough earnings to get points for the extension

Thanks for stopping by and your reply.
I tried to do some research myself in UKBA website but neither did I find anything that suggest previous years earnings doesn't matter nor the otherwise.
any ideas where information about previous years earnings is posted in UKBA webpage for Tier1 (G) extensions ?

It appears as grey area to speak, UKBA has not mentioned in their application form or policy guidance abt previous years earnings so do I Ignore previous yrs earnings and focus on just last 12 months income ? I am confused.

12-month period during the 15 months
immediately before the date of applying. An
applicant may claim points for a 12-month
period of earnings outside of this 15 months if
they can show that he/she has been"



so as long as you can prove 12 month income in last 15 months..you are fine. there is no confusion, its simple rule.

Great, thanks for dropping by and for your help.

Just now a new issue crossed my mind, when I originally registered as sole trader (self employment) way back during dark ages ! I was given UTR number by HMRC however I had to stop my self employment status for some time being as I was not doing any business at the time.
I am listed as self employed in HMRC records all the way upto fiscal yr 2010-2011 but stopped self employment in may time 2011 I think.

In july 2012 I have changed my status to self employed again, I do have letter from HMRC confirming that I am self employed from july 2012 however it has no mention of UTR number on it .
I am not sure if my old UTR number would continue as my current one or do I have to request new one from HMRC ?
This has literally just crossed my mind , I will have to clarify this with HMRC on monday.
If any of you guys have any idea abt this please add your thoughts, would be a great help, much appreciated :)

I would like you to assist on the following scenario. I posted the same scenario in other forum but did not get reply except manka 10,

I was issued a tier general visa on March-11 on the basis of salary and self employment(UK earnings). I am paying tax (paid 80%)

2009/2010 tax paid
2010 / 2011 tax paying
2011 / 2012 will be paid in January 2013

I am working as a IT lecturer in the UK(midland).I have got business in overseas and self employed registered for tax purposes. I was in overseas for 6 weeks and did self employed business there and availed good project. I had to back to the UK as the college started in September-12. I am still working on overseas project in the UK but the monies are being credit in overseas account as my clients reside there.
The UK business is also going well

Queries:
1 Can I claim overseas earning for the period while I was not physically present in overseas (i.e earnings after September 12 till Feb-13 approx)

2 I have got enough earnings point through lecturer job and overseas earning but have UK business as well in profit of 12K. Do I have to include UK earnings for claiming points?

Extension due in March 13

Hope to get a reply soon
