Sponsoring wife for family visitor visa I am have ILR

Post by faislondon » Thu Mar 28, 2013 11:13 pm

Dear Friends,

I want to apply for my wife's family visit visa. I have previously applied her visit visa under General visitors category twice byt got rejected. In second rejection they refused saying that my wife does not have enough tie up back home and she would not return. Also that they do not know my immediate immigration status after 18 march which was my visa expiry date. We applied on 03 Jan 2013 and received refusal after 15 days.
Now I have received ILR on 16 mar 2013. I am applying her family visit visa since she takes care of my family and property back home. Reason I am not applying her dependent visa. I want her to come and see me for a short visit for 1 month and return. Under family visit visa category we will also I have full appeal rights.
I will be sponsoring her trip. She is a housewife.

See my response under your other post on this same topic: http://www.immigrationboards.com/viewtopic.php?t=130608

The key aspect I see missing here, is proof of your wife's ties to her home country. I.e. the reason for her previous refusal. You/she needs to convince the ECO that she will leave the UK at the end of her visit.

The only pieces of evidence which suggest she may have some ties are the bank account and the home property you mention. The property is in your name, the bank account is in joint names. In addition to that, you are now settled in the UK - which can in this case run against her, because it shows her ties to the UK are greater than her ties to her home country. MHO is that she will need to show more than that to convince an ECO of her intent to return at the end of her visit (especially after the former refusal you mention). Both of you will need to think about what else she can supply to prove this.
