Student Visa query

Hi.

I live in a shared house, and just over a year ago, a 30 something Spanish woman moved in. She must have signed up for a college course, as a few weeks later we started getting cards through the door from the college asking where she was, as she hadn't turned up. She's also left post lying around the place indicating she was given financial support to study, and we know for sure she's claiming housing benefit.

She doesn't go out to study or work, she just hangs around the place and has other Spaniards round regularly for drinks. She's essentially on holiday at the tax payer's expense, and she's wasted a place on a course that could have gone to somebody who really wanted it.

If she's got a student visa to stay this long, might she be in breach of it, if she obtained a place at college but has never carried out her studies?

Spanish nationals do not require a visa to study/work/reside in the UK. The question of her being in breach does not therefore arise. She may be abusing the benefits system but without knowing her particular circumstances, it is impossible to pass judgement on the issue. Have you tried taking it up with the landlord/agent?
